02'7 January_ 28~ 1997 At a Regular Meeting of the City Council held on Tuesday, January 28, 1997, there were present: Mayor JameS W. Holley III, Vice Mayor Johnny M. CJemons, Bernard D. Griffin, Sr., James T. Martin, Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas Berm III, Ronald W. Massie, City Manager, G. Timothy Oksman, City Attorney. Vice Mayor Ciemons opened the meeting with prayer which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion of Mr. Pitts, and seconded by Mr. Clemons, to approve the minutes of a Called Meeting on January 14, 1997; a Regular Meeting on January 141 1997; and was adopted by unanimous vote. 97 - 20 - Presentations: · Proclamation presented to Rodney Eric Vinson for "Rodney Eric Vinson Day." · proclamation presented to Robert weaver, Todd Perrine, Mary Johnson, and Rebecca Howard for "The Portsmouth Family Marathon Blood Drive Day." · Presentation of special lapel pins to newly appointed Boards and Commissions members. UNFINISHED BUSINESS - 97-05 - A rezoning and a use permit: Motion by Mr. Martin, and seconded by Mr. Robinett, to adopt the follOwing ordinance and resolution, approved on first reading at the Public Hearing meeting on January 14, 1997, and was adopted by the following: 97-05 (a): "ZONING AMENDMENT ORDINANCE Z-96-10". 97-05 (b): "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF AN AUTO WHOLESALE BUSINESS AT 2200 FREDERICK BOULEVARD. WHEREAS, Donald R. Baker, owner of 2200 Frederick Boulevard, has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an auto wholesale business to be located at 2200 Frederick Boulevard, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use;
