266 April 24th, 1951. 3rd - "I am submitting a copy of a letter that I have written Nr.A.R. Brinkley, Super- imtendent of the Atlantic Coast Line Railroad Company, Norfolk, Va., concerning the purchase of the remainder of the Armistead Branch right of way of the Atlantic. Coast Line Ra~ Comfy for the City of Portsmouth. I recon mend that the City Council concur in m~ action f~ this m~tter." Motis~ of Nr. Houghton to concur in the recommendation of the City Manager,was adopte~. ~th - "I am suk~itting a plat showing lots owned ~y the City of Portsmouth and Fletch~ Taylor, adjacent to Pine Street iu Portsmouth, Va., and I recommend that the City of Portsmouth deed to Fletcher Taylor, lot shown on plat appr~a~mately 30 feet by ~0 feet for a stm~ar parcel of land fren$ing approximately 91 feet on G~lffin St. and extending back 135 feet to the property of the Seaboard Air Line Railroad and extend- iug on the said ~ p~operty a distance of approximately 165 feet. This exchange is to be one for the other with no remmneration of cash by either party. I recommend that this exchange be made." N~tion of Mr. Bilisoly to concur in the recommendation of the City Manager was adopted and by the following vote: Ayes: Duke, Bilisoly, Grimes, Houghton, Howard, Smith, Sturtevant, l~arren N~ys: None 5th - "I submit herewith a lease dated March 31, 1951, between the City of P~rtsmouth and the P~rtsmouth Mills, Inc., for the rental of the space on the third floor of the N~rket Building. I recommend that the Mayor be authorized to execute the agreement on the part of the City of Portsmouth and that the City Clerk Be directed to attest the same and affix the city seal thereto. Motion of Mr. Warren that the Mayor be authorized to sign and the City Clerk to affix the seal of the City and attest, was adopted, and by the following vote: Ayes: Duke, Bilisoly, Grimes, Houghton,Howard, ~mith, Sturtevant, Warren Nays: None 6th - "A letter has been received f~m the Hen. David L. Lawrence, President of the United States Conference of ~ors advising of a proposed decision by the Federal communieati~ns Commission whew by certain of the Television ~channels in the ultra-high f~equency portions of the Television spectrum are reserv- ed for non- commercial educational purpos~s. The Federal Conm~Auications Commissio~ has called for the ec~m~ents or objections concerning its proposal by April 23, 1951. Channel 21 ~n the ultra high frequency has been reserved for the Norfolk- Portsmouth area. and in order that the City of Portsmouth may subn~t evidence of substantial interest to the Fed- oral Co~mmnicatie~s Commission, it is necessary that a Resolution endorsing the allocation of a Television channe for the Norfolk-Portsmouth area he submitted. It is m~ understanding that L,I~.~ Wehb,Jr., Director of the College of W~].l.iam & Mary and the Virginia Polytechnic Institute iu Norfolk have expressed interest in behalf of the College. I uls~ Understand that both the Norfolk and Portsmo~h schools are expected-to take' appropriate action and I am ad- vised that the City Council of Norfolk has adopted a s~lar resolution. I therefore recommend that the attache~ resolution be adopte~ by the Council of the City of Port~mouth, Virginia." Resolution - A B~SOLUTION ~TDORSING THE ALLOCATION BY THE FEDERAL CO~JNIGATIONS COmmISSION OF T~T.~ION C~ANNEDS TO THE NORFOLK-PORTSNOUTH AEEA, TO BE USED FOR NON- COI~MERCIAL EDUCATIONAL AND CULTURAL PUF~DSES. l~hereas, the Federal Communications Commission will, in the near f~ture, make a decision regarding the allocation of very high frequency and ultra- high frequency television channels to cities to be used for non-cowm~-rcial educational and cultural purposes; and ~rnerems, one ultra-high frequency television cha~nel has tentatively been allocated to the Norfolk-Portsmouth area; and Whereas, the Federal Conmmnications Conmission' desires an expression of interest from the cities so affected prior to making a finaI decision re- garding said allocations: and Whereas, in the opinion of the Council of the City of Portsmouth such pro- grams will greatly benefit the people of this City by expanding and revitaliz- ing education; and Whereas, the Council of the City of Portsmouth hms received many informal statements and endorsements from civic organizations, school officials, and private citizens expressing strong interest in the establishment of such'a television channel; now therefore, Be it Resolved by the Council of the City of Portsmouth: Section 1 - That the ~ouncil of the City of Portsmouth does fully endorse the permanent allocation of one or more tele- vision channels to the City to he used~ for non-commer- cial. educational and cultural pmrpeses. On motion of ~Ir. Grimes, said resolution was adopted. ?th - "I submit herewith a letter ~rom A. E. Parker recommending that Robert Samuel Rarna, 55 Victory Boulevard, Alexander Park, b8 refunded for.erroneously assessed .~t~axe. s in %he sum of $~.10. I recommend that 14r. Parker's request he approve~ and that the City Auditor be authorized to refund Nr. Barna the amount stated above." Notion of Mr. Warren to refund Nr.
