January 8, 2002 <br /> <br /> 2. That Zion Baptist Church is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate an adult day <br />care center (S.I.C. 8361) at 633 High Street, and being more particularly described as: <br /> <br />UP-01-26 <br /> <br />Beginning at the southeast corner of High Street and Green <br />Street; thence, in an easterly direction 60'+ to a point; <br />thence, in a southerly direction 114'+ to a point; thence, in a <br />westerly direction 60'+ to a point; thence, a northerly <br />direction 114'+ to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br /> (a) The occupancy of the adult day care center shall be limited to thirty-five <br />(35) clients. <br /> <br /> (b) Days and hours of operation shall be limited to Monday through Friday <br />from 6:00 a.m. to 6:00 p.m. <br /> <br /> (c) The applicant shall maintain a minimum of seven off-street parking spaces <br />for the adult daycare center. <br /> <br /> (d) Drop-off and pickup of clients shall take place along Green Street and <br />King Street. <br /> <br />(¢) The center shall comply with the submitted floor plan. <br /> <br /> (t') The applicant shall provide an approved plan to store, handle, and remove <br />trash/garbage on-site. <br /> <br /> (g) The Downtown Design Committee must approve all signage and exterior <br />renovations prior to the start of work. <br /> <br /> (h) The center shall submit to all required inspections by the City's Fire <br />Department Bureau, Public Health Department and Building Official. Inspections shall <br />include an initial inspection prior to the opening of the business and annual inspections <br />thereafter. <br /> <br /> (i) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br />Abstained: Robinett (Mr. Robinett abstained because of employer direct interest). <br /> <br />- City Manager's Report - <br /> <br />02 - 09 - Adoption of an ordinance to amend Chapter 10, Section 121, of the Code of <br />the City of Portsmouth related to a change in the location of Precinct 38, from <br />Churchland Branch Library, to Grove Baptist Church, 5910 West Norfolk Road, which is <br />a large facility and will accommodate the number of voters in the precinct. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Chapter 10, Section 121, of the Code of the City <br />of Portsmouth related to a change in the location of Precinct Number 38, Churchland <br />Branch Library, 3215 Academy Avenue, to Grove Baptist Church, 5910 West Norfolk <br />Road. <br /> <br /> <br />
