January 8, 2002 2. That Zion Baptist Church is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate an adult day care center (S.I.C. 8361) at 633 High Street, and being more particularly described as: UP-01-26 Beginning at the southeast corner of High Street and Green Street; thence, in an easterly direction 60'+ to a point; thence, in a southerly direction 114'+ to a point; thence, in a westerly direction 60'+ to a point; thence, a northerly direction 114'+ to a point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The occupancy of the adult day care center shall be limited to thirty-five (35) clients. (b) Days and hours of operation shall be limited to Monday through Friday from 6:00 a.m. to 6:00 p.m. (c) The applicant shall maintain a minimum of seven off-street parking spaces for the adult daycare center. (d) Drop-off and pickup of clients shall take place along Green Street and King Street. (¢) The center shall comply with the submitted floor plan. (t') The applicant shall provide an approved plan to store, handle, and remove trash/garbage on-site. (g) The Downtown Design Committee must approve all signage and exterior renovations prior to the start of work. (h) The center shall submit to all required inspections by the City's Fire Department Bureau, Public Health Department and Building Official. Inspections shall include an initial inspection prior to the opening of the business and annual inspections thereafter. (i) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain all necessary licenses and permits. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Recommendation: · Adoption of an ordinance to amend Chapter 10, Section 121, of the Code of the City of Portsmouth related to a change in the location of Precinct Number 38, Churchland Branch Library, 3215 Academy Avenue, to Grove Baptist Church, 5910 West Norfolk Road.
