<br /> "This is ~with reference to the compositionand operations of the Portsmouth Redevelopment and
<br />~ousing Authority which was brought into being under the Code of Virginia, Title 36, entitled, "Housing Authori-
<br />ties Law", which provides for the appointment by the Mayor-of each City in which a Redevelopment and Housing Autho-
<br />rity has been activated , of five (5) residents'to serve as commissioners (members) of the Authority.
<br />
<br /> In this connection, your attention is invited to the following sections of the Code of Vir- i
<br />ginia:
<br />
<br /> 'Article 1 - General Provisions
<br /> 36.3 Definitions - The following.terms, when used or referred to in this Chapter,
<br /> shall have the following respective memnings, unless a different meaning~clearly
<br /> appears from the context:
<br /> (f) 'Area of Operation': (1) In the case of a housing authority of a city shall
<br /> be co-extensive with the territorial boundaries of the city; (2).in the case of a
<br /> housing authority of a county, shall include all of the county except that portion
<br /> which'lies within~the territorial 'boundaries of any city, as herein defined.
<br />
<br />Article 2 - Commissioners, Officers, Agents and Employees
<br />36.16. Prohibited Interest - No commissioner, officer, agent or.employee of an
<br />authority shall acquire any interest direct or indirect in any housing project
<br />Or:-in any property.included or planned to be included in any project, nor shall
<br />he have any interest direct or indirect in any contract or proposed contract
<br />for materials or services to be furnished or used in connection with any housing

<br />36-18. ~eetings and-Residence of Commissioners. Nothing contained in this
<br />chapter shall be construed to prevent meetings of the commissioners of a housing
<br />authority anywhere ~within the ~t~imeter boundaries of the~ area;off, operation of the
<br />author ity or 1within any additional area~where the housing altthority is authorized
<br />to undertake a housin~project~ nor to prevent~he appointment of any person as a
<br />commissioner of the authority who resides within such boundaries or such additional
<br />area, and who is otberwise~..eligible~for~such appointment under this chapter.(1942,
<br />p. 325; ~ichie Code 1942, ~ 3145 (4m) 8.~'

<br />Now with respect to the provisions of Section 36-16, it is widely believed that some
<br />Commissioners (members) of the Authority might have-private interests which ~re~or
<br />have been in conflict wi~h the requirements of this provision of the law. In fair-
<br />ness to both the pub!ic~an~ %he Commissioners (members) of the Authority, it is re-
<br />quested that appropriate action be initiated by Fou to have the properJ~geucies of
<br />the Federal mud~State Governments determine~throughJinvestigation, whether or not
<br />any violations of this provision of the law haveoccurred; and take such remedial
<br />action as may be deemed proper and necessary.
<br />
<br />As to Section 36-18, it readily appears that zwo-com~issioners (~embers) namely ~r,
<br />George T.McLean, Green Acres Farm, and M2. E.C. Allen, Pinec~oft I~ne, Churchland,
<br />of the Authority, are ineligible for service on the Authority, since~they are cur-
<br />rently reported as residents of Norfolk County, Virginia.
<br />
<br />It is requested that immediat~determi~u%tion be made as ~o the residence of these
<br />gentlemen, and if as generally believed, they are found to be resident~ of Norfolk
<br />County, Virginia, their resignations be obtained without delay; and if such resig-
<br />uations are notsubmitted, their appointments be terminated by you in accordance
<br />with the law~.
<br />
<br />The General public has belatedly, it is ~rue, become acutely aware of the opera-
<br />tions of the Portsmouth Redevelopment and Housing Authority and is quite properly
<br />disturbed over its recently proposed projects. The manner and methods pursued by
<br />the Authority in attempting to achieve its objectives, to say the least, leave
<br />much to be desired from the standpoint of good public relations.
<br />
<br />In view of the importance of these matters, and the fa~t that a considerable number
<br />of people are intemested in them, it is requested that the writer be advised by
<br />letter of the a etlon taken by you With reference thereto."
