<br />and 1869 against." The Canvass showed a vote of 94~ for

<br />A. MacKenzie, were road:The following letters from Wm Hedges Baker, L. E.' Turlington, W.B. Spong, Jr., and John
<br />
<br /> "As I will not have opposition in the July primary and h~ve been declared the party nomi-
<br /> nee for'Clerk of the Court of Hu~tings of the City of Portsmouth,, I will appreciate it very much if you will take
<br /> such action as is necessary to return to me my filing fee of $180.00."
<br />
<br /> "I am requesting a refund of $170.00 fee account of no opposition to the office of Com-
<br />missioner of the Revenue, in the election of J~ly ~4, 1953."
<br />
<br /> "On or about the 8th of'April, of this year, I paid a filing fee of $21.60 '~o A.E.P~rker,.
<br />City Collector, in order ~o become a candidate for the House of Delegates.
<br />
<br /> Since only ~wo candidates qualified for election, I am informed that our names will
<br />not appear on the ballot, and therefore, I ament~tle~' '~ ~to a refund of this money upon requesting you for such.
<br />
<br /> Therefore, I should like to ask ~hat I be refunded this money."

<br /> "In view of the fact that nobody chooses to ~un against me in July, a~ your convenience,
<br />I would appreciate your returnihg my $21.60-filing fee."
<br />
<br /> Motion of Mr. Bilisoly that refunds be granted, was adopted.
<br />
<br /> Mr. Wilson, speaking for the Central Memorial Day Co~nittee, requested that the Council
<br /> appropriate $75.00 rather than the $50.00 previously appropriated for the Committee.
<br />
<br /> ~otion of Mr. Wilson to appropriate a~ additional $25.00 was adopted.
<br />
<br /> Motion of Mr. Smith to sugpend the rules to hear from Joseph P. Donlan was ~dopted.
<br /> Mr. Donlan presented the following letter:
<br />
<br /> "This is to direct your a~rention to the Code of Virginia, Section No. 15-396, Number
<br />of Wards in City; Section No. 15-399, Council to reapportion representation among wards; 15-400~Mandamus on fail-
<br />ure to reapportion representation as changes in boundaries of wards. Briefly summarized, the requirements of these
<br />sections of the Code are:
<br />
<br /> (1) Sec. 15-396- the Council is required to redistrict the City whenever it appears
<br />that the population (as shown by th~ last U.S.Census) ~n any ward exceeds that of any other ward by so much as
<br />3,000 inhabitants;
<br /> (2) Sec. 15-399 - the Council zn every City in the year 1953 and every tenth year
<br />thereafter, and also whenever the boundaries of the wards of the City are changed, prescribe by ordinance the
<br />number of members of each branch of the Council and 'reapportion the representation therein among the wards, so as
<br />to give as far as practicable to each ward of such city equal representation;
