<br />At a regular meeting of the City Council, held on February 23rd, 1954, there were present:

<br />54-55. Minutes of regular meeting of February 9th, 1954 were read and approved.

<br />The following no,ice of hearing of zonin~ changes was read:
<br />
<br />'~ursuant to the provisions of the Zoning Ordinance, notice is hereby given that a
<br />public hearing will be held at 7:30 P.M., on Tuesday, February 23, 1954, in the
<br />Council Chamber, Municipal Building, Portsmouth, Virginia, for the purpose of alter-
<br />ing zones and reclassifying the following property:
<br /> 1. W.H. Channel to rezone lots 11-112-i14 and 118, fronting 106 feet on the
<br /> west side of Fifth Avenue and fronting i20 feet on the south side of Queen
<br /> Btreet from Two Family Class C to Commercial Class G.
<br /> 2. C.L. Edwards to rezone lots 25 and 26 in block 27 beginning 85 feet north
<br /> from Gosport Road, fronting 50 feet on the east side of Des Moines Avenue
<br /> by 100 feet deep, from Two Family Class C to Commercial Class F.
<br /> 3. Amdusky and others to rezone lots 5 thru 12 and lots 22 thru 26 block A the
<br /> southwest corner of Airline Turnpike and Hamilton Avenue fronting 330 feet
<br /> on the south side of Airline Turnpike and fronting 255 feet on the west side
<br /> of Hamilton Avenue by 10G feet deep from Tw~ Family Class C to Commercial
<br /> Class G."

<br />'~t the meeting of the Portsmouth Planning and Zoning Commission held February 4th, 1954,
<br />the following applications were considered and subsequent recommendations submitted for
<br />your approval:
<br /> 1. W.H. Channel to rezone lots 110-112-114 and 118, fronting 106 feet on the
<br /> ~est side of 'Fifth Avenue and fronting 120 feet on the south side of Queen
<br /> Street from Two Family, Class '~" to Commercial, Class '~" be approved.
<br /> 2. C.L. Edwards to rezone lots 25 and 26, in blocs 27, beginning 85 feet north
<br /> from Gosport Road, fronting 50 feet on the east side of Des Moines Avenue by
<br /> 100 feet deep, from Two Family, Class "C", to Commercial Class "F", be approved.
<br /> 3. J. R. Boyd To rezone the southweast corner of OwenStreet and Leckie Street,
<br /> fronting 53 feet on the south side of Leckie Street and fronting 90 feet on the
<br /> east side of Owen Street from Multiple Family, Class "E" to Commercial, Class "G"
<br /> be denied.
<br /> 4. A. Amdusky and others to rezone lots 5 thru 12 and lots 22 thru 26, block "A",
<br /> the southwest corner of Airline Turnpike and Hamilton Avenue, fronting 330 feet
<br /> on the south side of Airline Turnpike and fronting 255 feet on the west side of

<br />Motion of Mr. Wilson to approve the application of W.H. Channel was adopted.
<br />
<br />Motion of Mr. Grimes to approve the application of C.L. Edward's was adopted.
<br />
<br />Motion of ~r. Houghton to approve the application of A. Amdusky and others, was adopted.
<br />
<br /> Motion of Mr. Smith to concur in the recommendation of the Planning Commission as to the
<br />application of J.R. Boyd, was adopted.
<br />
<br />54-56. Motion of Mr. Bilisoly to suspend the rules to hear from Henry W. MacKenzie, was adopted.
<br />
<br />MacKenzie presented the following petition:

<br />"Your petitioners, J. Roy Rodman and Ennis H. Rodman, respectfully represent:
<br />
<br /> A. That they are the owners in fee simple of all the land in Blocks L., M, Q., and R,
<br />as shown on the Plat of the Bishop Tract which is duly recorded in the Clerk's Office of the
<br />Circuit Court of Nor~lk County, Virginia, in Map Book 3, Page 71, except lots 174 through
<br /> in Block R which are owned by Jerome P. Cart and lots 2?5 .through 279 in Block L,which
<br />are owned by Portsmouth Medical Building Corporation, the area in question embracing all of
<br />the Platted portion of the Bishop Tract lying West of Hamilton Avenue and bounded by High
<br />Street on the South and Glasgow Street on the North.
<br /> B. That within the said area Vermont Avenue is shown on said Plat of the Bishop Tract
<br />as running North and South between Blocks Q and L on the-Ea~t and R. and M. on the West
<br />northwardly from High Street to a dead end at the end of the line of the Bishop Tract be-
<br />fore it reaches Glasgow Street; and Queen Street is shown on said Plat as running west-
<br />wardly from Hamilton Avenue between Blocks Q and E on the South and L and M on the North
<br />to a dead end at the west line of the Bishop Tract.
<br /> C. That neither Vermont Avenue nor Queen Street within the aforesaid bounds has ever
<br />been opened,improved or used.
<br /> D. That your petitioners desire to vacate that portion of Vermont Avenue within the
<br />aforesaid area which lies North of the South Line of Queen Street and South of the property
<br />line of the Bishop Tract and that portion of Queen Street within said area which lies west
<br />of Hamilton Avenue and eas~ of Vermont Avenue.
<br /> E. That your petitioners are the owners of all land on both sides of the portion of
<br />said streets sought to be vacated and they are advised that Jerome P. Carr and Portsmouth
<br />Medical Building Corporation, the only other property owners within the area (who do not
<br />abut on the portion of said streets sought to be vacaled) do not object to such vacation.
<br /> F. That the instrument whereby such vacation is to be accomplished to be executed by
<br />the interested property owners is attached hereto.
<br />WHEREFORE, your petitioners pray, pursuant to the authority contained in Section
<br />15-766.1 of the Code of Virginia that the vacation of such portions of Vermont Avenue
