At a reEuiar meezing of the,City Council, held on March 27th, 1956, there were present: Fred A Duke, B. W. Baker, Frank N. Bilixoly, George L. Grimes, R.E. Hawks~ E. W. Lawrence, R. Ix~ine Smith, E.g. Sturtevant, Pestle J Wilson, I.G. Vase, City Na~ag~r, and E. C.Barclay, City Attorney. Smith excused. Minutes of previous meeting were read and approved. 56-92 - The following Notice of Zonin~ changes was read: "P~rsuant to the provisions of the Zoning Ordinance, notice is hereby given that a public hearing wilt be held at ?:30 P.M., on Tuesday, ~arch ~?, 1956, i~ the Council Chamher~ Municipal B~ilding, Portsmouth,Virginia, for the purpose of altering zones and reelassifying the followinE prope~y: 1.Les Barnes and A K Sheek to rezone lots 5,7,9,10,I1,1~13,15,17 and portions of lots ~,4,8~8, block 113, fronting 170 feet on the emst side of Airline Boulevard and 180 feet on mhe south side of Bri~hton Street; and portions of lots I4,16,1$,E0,ZE and R4, blo. ck ll3 fronting 1Z0 feet on the east side of Air- line Boulevard by 18~ feet on the north Side of He~3~y~St., by 88 feet deep "C'! Two Family Dwellin~District to "F" Local Business District. ~. City of Portsmouth ~o rezone the area situated on the south side of County Street be- tween County St. and the Seaboard Railroad yards, extending f~om Sixth Avenue east to a point approximately El0 feet east of Fourth Ave. from "C" Two Family Dwelling and "~' C~zmmercial Districts to "I" Light InduStrial Dis- trict. 3. ~onroe Forres~ and Waiter Boush to rezone property a~ the southeast corner of South Street and Atlanta Avenue fronting 131.3 feet on Atlanta Avenue and ~8.? feet on South Street lots I, ~, 3,4, l0 and 1~ block C from "C" Two Family Dwelling District to "G" Commercial Dis.trict." "At the Pl~nnin~ Commission meeting held on ~March 1, 1958, the following petitions for amendments ~o the zoning map were acted upon and subsequent recommendations ~r~ submitted for your consideration: = 7 1. This petition was previously acted ~pon hy the Planning Commission hut had been refer- red back to them by City Council for reconsideration. At the meee~ing oa Notch l, the Planning Commission again held a public hearing. The Planning Commission recommends approval of this petition. ~. City of Portsmouth to rezone the are~ situated onthe south side of County Street,between ~County Street and the Seaboard Railroad yards, extending from Sixth Aven~e east ~o a ~i~t approximately ~10 feet east of Fourth Avenue: zo 'I' Light Industrial District. Presen~ zonin~ is 'C' Two Family Dwelling and 'G' Com merci~l. This he,ring ~as iz~itiated by the Plannin~ Commission in order to consider at one time the feasibility of .rezoninE a~ area of some two full blocks in extent. If ~he present residential zoning is kept it is anticipated that there will he individual requests for the spo~ zoning of lots within this area. At the Rlaoning Commission hearing, no one ap~ared in oppositio~ to the propesed change in zoning district. It is recommended thaz this change be approved. 3.. ~ouroe Forrest and Walter Boush to rezone proper~y a~ tlu~ southeast corner of South S~reet e~d Atlanta Ave., fronting 131.3 feet oa Atlanta Ave. and I05.7 feet on South Street; lots i, ~, 3, 4, lO and block C: from 'C' Two-Family Dwelling District to 'G' ~omm~ercial District. There ~ no opposition to this proposed chan~e ~at the Planning Comm~ ssion heam~ing. It is recommen%ded that this application De approved.~' F.J. ~oo.dy, representin~ Les Barnes and A.K. Sheek, spoke for thins application and pre - seated the following petition: "W~ the undersigned persons who own prope~y in the vicinity of the proper~y now owned by Leslie S Barnes, A K Sheek ~nd Leslie S.Ba~nes~ Jr., on Airline Boulevard and Brighton S~., for which.they have .iaa~e an application for rezoning from two family, Class 'C' ~o Commercial Class ~F', Local Business, have no objec- tion · o and recommend the rezoning of this proper~y as they have requested. Signed - GoA. Covert, ~101 Wyoming Ave~ and others." The following people spok~ for this application: Mr. Dail, Mr. ~chofield, k%r. Culpepper, NLr. Houghton, Mr. Harper and Mr. Covert. The following letter was read, opposing this rezoning change: "The Westhaven Park Civic League at a special meeting, held ~ March 1958~ voted unani- mously to oppose the proposed rezoning of the severally numbered parcels of land located within the bloc~ bounde~ by Henry Street, Rodman Avenue, Brighton Street and Airline Boulevard, and further identified as tots 5, 7, 9, 10, ll, lZ, 1S, 15, 17 and portions ef lots ~,~,8,8,14,18,18,~0,~, ~4 of block llS. The League is of the opinion tha~ rez~u~ng these lots for other than dwelling use would materially depreciate the values of residential properties which border on three sides of the above described area. The League is further of the opinion that vehicular traffic attracted to the proposed husd~ess establish- meat would further endanger the many children, who, because of necessity are funneled through this area on their way to and from school. For these and numerous other reasons, which will be presented ~o Council by League rep- resentatives, the League respectfully petitions your honorable body to disapprove the request for rezoninE the above described parcels of land.
