That Jama[ and Alanna Smith are hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />operation of an adult residential care facility on property located at 711 Washington <br />Street, and being more particularly described as: <br /> <br />UP-97-10 <br /> <br /> Beginning at the northeast corner of the intersection of Washington Street and <br />Columbia Street; thence, east 90'_+ to a point; thence, north 55'+ to a point; thence, <br />east 90'_+ to a point; thence, north 60'_+ to a point; thence, west 90'_+ to a point; <br />thence, north 20'_+ to a point; thence west 90!_+ to a point; thence, south 160'_+ to the <br />point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The facility shall be limited to a total of five (5) residents. <br /> <br /> (b) The applicants shall provide three (3) off-street parking spaces. A site <br />plan shall be provided for approval by the Director of Community Quality and <br />Planning Services. <br /> <br /> (c) The applicants shall provide landscaping in accordance with a plan <br />approved by the Director of Community Quality and Planning Services: <br /> <br /> (d) The applicants shall comply with all applicable codes, ordinances and <br />regu at ons of federal, state and local governments and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> (e) The facility shall be inspected annually by the City Fire Departmen[, the <br />Health Department and the Building Official. <br /> <br /> (f) The use permit is issued to Jamal and Alanna Smith and shall not be <br />transferable. <br /> <br /> 4.
