.15-4 June 24.1997 At a Regular Meeting of the City Council held on Tuesday, June 24, 1997, there were present: Mayor James W. Holley III, Vice Mayor Johnny M. Clemons, Bernard D. Griffin Sr., James T. Martin, Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas Benn I11, Ronald W. Massie City Manager, G. Timothy Oksman, City Attorney. Councilman Pitts opened the meeting with prayer which was followed by the Pledge of Allegiance to the Flag. :Mayor Holley called the meeting to order and welcomed all in attendance. Motion of Mr. Clemons, and seconded by Mr. Martin, to approve the minutes of a Called Meeting on June 10, 1997; a Regular Meeting on June 10, 1997 with the noted correction of the vote for agenda item 97-168(a); and was adopted by unanimous vote. - UNFINISHED BUSINESS - 97-168 - Rezoning and use permits: 97-168(a): Motion by Mr. Clemons, and seconded by Mr. Pitts, to adopt the following ordinance, and was adopted by the following vote: "ZONING AMENDMENT ORDINANCE Z-97-07." Ayes: Clemons, Griffin. Martin, Pitts, Robinett,'Holley Nays: Berm 97-168(b): Motion by Mr. Pitts, and seconded by Mr. Clemons, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A RES IDENTIAL CARE FACILITY FOR ADULTS AT 711 WASHINGTON STREET. WHEREAS, Jamal and Alanna Smith have made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an adult residential care facility (S.l.C. 836) to be located at 711 Washington Street, Portsmouth, Virginia, as hereinafter described; and WHEREAS, the applicants and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use: (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood;
