.15-4 <br /> <br />June 24.1997 <br /> <br /> At a Regular Meeting of the City Council held on Tuesday, June 24, 1997, <br />there were present: <br /> <br /> Mayor James W. Holley III, Vice Mayor Johnny M. Clemons, Bernard D. <br />Griffin Sr., James T. Martin, Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas <br />Benn I11, Ronald W. Massie City Manager, G. Timothy Oksman, City Attorney. <br /> <br /> Councilman Pitts opened the meeting with prayer which was followed by the <br />Pledge of Allegiance to the Flag. <br /> <br /> :Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br /> Motion of Mr. Clemons, and seconded by Mr. Martin, to approve the minutes <br />of a Called Meeting on June 10, 1997; a Regular Meeting on June 10, 1997 with the <br />noted correction of the vote for agenda item 97-168(a); and was adopted by <br />unanimous vote. <br /> <br />- UNFINISHED BUSINESS - <br /> <br />97-168 - Rezoning and use permits: <br /> <br />97-168(a): <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Pitts, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br /> "ZONING AMENDMENT ORDINANCE Z-97-07." <br /> <br />Ayes: Clemons, Griffin. Martin, Pitts, Robinett,'Holley <br />Nays: Berm <br /> <br />97-168(b): <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Clemons, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A <br />RES IDENTIAL CARE FACILITY FOR ADULTS AT 711 WASHINGTON STREET. <br /> <br /> WHEREAS, Jamal and Alanna Smith have made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />granting of a use permit to operate an adult residential care facility (S.l.C. 836) to be <br />located at 711 Washington Street, Portsmouth, Virginia, as hereinafter described; <br />and <br /> <br /> WHEREAS, the applicants and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said <br /> use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br /> Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br /> working in the neighborhood of the proposed use: <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br /> improvements in the neighborhood; <br /> <br /> <br />
