<br />At a regular meeting of the City Council, held on April 23rd, 1957, there were present:
<br />
<br />A. C. Bartlett, B. W. Baker, W. E. Hinton, Frank L. Kirby, John E. Scott,
<br />R. Irvine Smith, H. Earl Weiseman, I.G. Vass, City Manager, and R.C.Barclay,
<br />City Attorney.
<br />
<br />The meeting was opened with prayer by Wm. E. Hinton.
<br />
<br />Minutes of the previous meeting were read and approved.
<br />
<br /> 57-148 - Motion of Mr. Scott to suspend the rules to hear from Clyde W. Cooper, was
<br />adopted.
<br /> Mr. Cooper~ representing approximately one hundred High St. merchantS~ spoke and presented
<br />a petition opposing the proposed restriction on parking on High St., between the hours of four and six in the after~
<br />
<br /> ~eO~ E. ~arker also spoke opposing the proposed restriction.
<br />
<br /> The-fellow-lng letters from the City Manager were read:
<br />
<br /> 57-149 - "It is in order mo consider the report by the City Attorney and City Manager ertl
<br />the removal of s house on Airline Boulevard."
<br />
<br /> The City Attorney stated that he knew no legal steps that could he tmken for the removal
<br />of the house on Airline Boulevard.
<br />
<br /> Motion of Mr. Baker that the proper city officials be instructed to enter an injunction
<br />against the owner of the proper~y at ll09 Airline Boulevard preventing any occupancy of the premises, was adopted
<br />and hy the fQ$1ewing vote:
<br />
<br />Ayes: Baker, Scott, Smith, Weiseman
<br />Nays: Bartlett, Hinton, Kirby
<br />
<br />ployed, was adopted,

<br /> Motion of Mr. Hinton that this matter be delayed until an assistant City Attorney is em -

<br /> 57-150 - "It is in order to hear from Council~a~Baker with reference to petition for
<br />rezening of ToF~ Culpepper." ~
<br />
<br /> Motion of Mr. Baker to refer ~to the City Attorney 'the question of the power of the
<br />City Council to rezone property without the recommendation from the Planning Co~mission, was adopted.
<br />
<br />Mr. Smith voting 'No'.
<br />
<br />57-151 - "It is in order that George R. Walker be heard'st this time."
<br />
<br />Mr~ ~Watker ~spoke opposing public housing in the City of'Portsmouth.
<br />
<br /> ~57-152-~ "~It is inorder to~-consider"a resolution presented by the Portsmouth Port
<br />a copy of which you have in,our files.''
<br />
<br /> On motion of Mr. Mcott~ the following resolation was adopted, and by the following vote:

<br /> "RJESOLUTION
<br /> P~EQUESTIN~ THE ELIZABET~ RIVER TUNNEL CO~ISSION TO PROVIDE FOR ~{E UTILIZATION
<br />OF EXCESS REVENUES FOR THE DEVELOPMENT OF T~E DISTRICT IN ANY FINANCIAL PLAN RESULTING FROM
<br />THE CONSTR~UTION OF A SECOND TUNNEL, - -
<br />
<br /> WHEREAS, the proposed building of a second ,tunnel between the Cities of
<br />Norfolk and Portsmouth will necessitate anew trust indentur~.~he~g prepared; and
<br /> WHEREAS, under.the present trust indenture of the Elizabeth River Tunnel
<br />Commission, there is no provision for the application of any revenue'~-~excess of the
<br />re~quirements for the operation of the facility and the servicing and amortization of the
<br />debt to any other project; and
<br /> WHEi~EAS, it iS the judgment of the City of Portsmouth, Virginia, that
<br />such excess revenue~ if any there be, should be made available for._such project as would
<br />tend to develop the Port facilities of the District no3v, therefore,
<br /> BE IT RESOLVED By the Council of the City of Portsmouth, Virginia
<br /> Section 1: ~ That .if a second tunnel .is constructed between the Cities
<br /> of Norfolk and Portsmouth, the Elizabeth River Tunnel Comm~s-
<br /> sion be, and it is hereby, requested to include in the trust
<br /> - indent~ure to Zinance .the ~projeet, ~if permlitted .by .law, a .pro
<br /> vision that would permit the allocation of exce~ss funds, beyond
<br /> those needed to safely ~pay its obligations, to another ~publi¢
<br /> agency or agencies to be used for the developmen~ of the Port
<br /> facilities .of the :District in ,a manner that the Commission feels
<br /> will reflect favorably on the reven~es of the Commission."
