The reasons are as stated above in connection with the Smith-Edwards <br /> petition. The subject lot is located on Jefferson Street adjacent to the west <br /> of the Smith-Edwards property. <br /> 3. Robert H. Jennings to rezone proper~y in block 2: lots 238 and 239, front- <br /> ing 50 feet on south side of Lindsay Ave. by 108 feet deep; lot 264, fronting <br />30 £eet on north side of George Washington Highway, by approximately 108 feet <br />deep; and lot 265, fronting 65 feet on north side of George Washington Highway <br />by approximately 70 feet deep. Application to rezone from ~F' Local Business <br />District to 'I' Light Industrial District. <br />By unanimous action the Planning Commission recommends that this petition be <br />denied. At the present time the land south of Geerge Washington Highway is <br />zoned 'I' Light Industrial District. The Ia~d abutting George Washington High- <br />way on the north is all zoned 'F' Local Business, and behind and north of this <br />the Brighton area ~s in a 'C' Two-Family Dwelling District. The P~a~ming ~om - <br />mission is of the opinion that the present zoning is good zoning , and that the <br />incursion of a sliver o£ light industrial land on the north side of George Wash- <br />ington Highway would be spot zoning and wou. ld open the door ~o many kinds of un- <br />desirable uses which could take place here. The Planning Commission has been ad- <br />vised by the Building Inspector that the plans submitted: ~or building on this <br />land are for the e~press purpose of a seat cover business and takes note of the <br />fact ~hat such a business is legal under the present zoning and does not require <br />light industrial zoning." <br /> <br /> Motion of Mr. Scott to concur in the recommendation of the Planning Commission on the <br />application of the Smith-Edwards Lumber Cpmpany, was adopt&d. <br /> <br /> Motion of Mr'.Scott to concur in the recommendation of the Planning Commission on the <br />application of Linwood W. Johnson, was adopted. <br /> <br /> Motion of Mr. Weiseman to concur in the recommendation of the Planning Commission on the <br />application of Robert M. Jennings, was adopted. <br /> <br />58-25 - The following letter from the City A~orney was read: <br /> <br /> "At the meeting of Council on January 14th, 1958, the request of the congregation of the <br />Church of God, 3516 Lincoln St., for refund of taxes on property at 3522 Lincoln Street, was referred to me for <br />further information. The information requested is given below. <br /> The subject property was conveyed by Leycester Gwaltney, et ux, to Joel Justice, et als. <br />Trustees by deed dated January 14, 1957, recorded in the Clerk's office of the Court of Hustings on January 18, <br />1957, in Deed Boo~ 306, page 339, <br /> Both halves of the 1957 real estate taxes in the total amount of $99.83 were paid on July <br />2nd, 1957. <br /> [£ refund is granted, taxes pro-rated from the date of the deed and the date of its re - <br />cordation are $96.00 and $94.91, respectively." <br /> <br />the Port Commission <br /> <br /> Motion of Mr. Weiseman to place a refund of $96.00 on first reading, was adopted. <br /> <br /> 58-35 - Mormon o~Mr. S~ott that the City Council go into the election of a ~ember of <br />for a five year term beginning January 1st, 1958, was adopted. <br /> <br />Mr. Weiseman nominated Charles R. Lively. <br /> <br />was adopted. <br /> <br />Mo~ion of Mr.Weiseman that nominations be closed and that the nominee be declared elected, <br /> <br /> NEW BUSINESS - <br /> <br />58-36 - The following letter from ~he Commissioner of Revenue was read: <br /> <br /> "Please be advised that Louis M. Boyd has been assessed for tangible personal property <br />valued for $430.00 with ~axes amounting no $ii.83. Our investigation reveals that the correct assessment should <br />have been $150.00 witb taxes amouhting to $4.13, representing an over-assesSment in taxes amounting to <br /> <br /> The taxpayer has.paid the original tax notice as evidenced by this inclosed receipt. As <br />this is definitely an overpayment of $7.70, we sincerely request that a refund in this amount be made to the Tax- <br />payer." <br /> Motion of Mr. Scott that refund of $7.70 be placed on first re~ding, was adopted. <br /> <br />58-37 - The following letters fro~ the Chamber of' Commerce were read: <br /> <br /> "At a meeting of the Board of Directors of the Portsmouth Chamber of Commerce, a motion <br />was unanimously passed to support that section of the Department of Education's report of the Commonwealth of <br />Virginia regarding a minimum of $3~000.00 for school teach'rs. <br /> <br /> <br />
