<br />At the regular meeting of Eity Council held ~arch 25th., 1958 there were present:

<br />A. C. Bartlett, B. W. Baker, Frank L. Kirby, John E. Scott~ R. Irvine Smith,
<br />H. Earl Weiseman, I. G. Vass, City Manager, and~ J. S.; Ltv&say, City Attorney.

<br />The meeting was opened with prayer by Father Farley.
<br />
<br />Minutes of the previous meeting were read and approved.
<br />
<br />The following notice of Zoning Hearing was read; also letter from Planning Commission
<br />
<br />58-90 - "Pursuan~ To the provisions of the Zoning Ordinance, notice is hereby given
<br />will be held at 7:80 P.M., on Tuesday March 25, 1958 in the Council Chamber, Municipal
<br />Virginia, on the following Application:

<br />James M. Caviness to rezone property-located on the east side of
<br />Dixie Avenue, 30 feet south of Grove Street, fronting 190 feet on
<br />Dixie Avenue by 105 feet deep on Mascot Street. Application to
<br />rezone from "C" T~0-FAbIILY DWELLLN-G district to "D" blULTIPLE FAMILY
<br />DWR~.~,ING district.

<br /> "At a meeting of the Planning Co~nission on ~rch 6, 1958, the following petition
<br />for amendment to the zoning mad was considered and subsequen~ recommendation is submitted for your consideration
<br />
<br /> James M. Caviness to rezone.property located on the east side of Dixie
<br /> Avenue, 30 feet south of Grove-Street, fronting 190 feet on Dixie Avenue
<br /> by 105 feet deed on Mascot Street. Application to rezone from "C" TWO-
<br /> FAMILY.DWELLING district re "D" MULTIPLE FAMILY DWELLING district.

<br /> The Planning Commission recommends that this petition be denied. All property
<br />surrounding the subject lots is in the "C" TWO-FAmILY DWELLING use district. It is noted that these lots have
<br />sufficient area to permit the construction of several two-family dwelling units." Paul S. Dulaney

<br /> 58-91 - ~Iay~r Bartlett reported on the Conference held with the Transportation Committee
<br />and their recommendation concerning fare increase was considered. This matter was referred back to the
<br />Committee for further investigation.

<br /> The following reports from the City I~anager were read:
<br />
<br /> 58-92 - "At a previous Council meeting you directed me' to submit a list of materials on
<br /> hand that would be available for CO~LS~ctin~ restrooms at playgrounds. You will find attached hereto a copy
<br /> of a letter from the Superintendent of Buildings and Grounds which sets forth ~e materials which he has
<br /> available for the construction of restrooms for playgrounds.
<br />
<br /> You will note that the estimat.ed~cos~ to co~lete l~vo restrooms with the available
<br /> materials on hand would be approximately $700,00.
<br /> I am also submitting herewith ~ proposal received from ~ir. John A. ~i~ra,~ (Iha~rman of the
<br /> Ways and Means Committee of the Ambassador Club of Portsmouth, Virginia wherein the Ambassador Club agrees to
<br /> construct a building at the Wythe-Street playground in accordance with the attached sketch~ the cost of the
<br /> plumbing, wiring and maintenance to be bo~e by the City of Portsmouth~ which would be approximately $300.00
<br /> In return for the construction of the building, the Ambassador Club requests a ten year
<br /> concession right at the Wythe Street playground.
<br /> There is some doubt in my mind about the feasibility of entering into a ten year agree-
<br /> ment for the concession rights; however, I am willing to recommend that the Ambassador Club participate in the
<br /> construction of the building for the concession rights and that anagreement be ~egotiated whereby the CiTy
<br /> would have the right to cancel the concession rights if it develops re the best interest of the City to do so."

<br /> "As requested as ~o amount of materials that are available to construct restrooms on
<br />playgronnds.
<br />
<br /> ~e do have all materials such as windows~ dQor, cinder blocks, roof rafters studding,
<br /> sheafing, plumbing ~i~tures and electrical materials to build two large restrooms 25' by 35', but will need
<br />such material as cement for floors, felt roofing, bix mix or mor~or to lay blocks. This will require an
<br />appropriation of $700.00 ~o complete t~wo restrooms.
<br /> We do have an~le labor to do the job.
<br /> I~ tke estimate that we gave in my original letter is to cover the overall p~oject, this
<br />being $30,000.00 for 11 playgrounds, if we were to purchase ali materials for the tl playgrounds, it would
<br />require $37,000.00.
<br /> We do have all windows, doors, roof rafter s~udding to help cut cost of restrooms for
<br />nine playgrounds." Sarry A. Phelps.

<br /> Motion of I~ir. Kirby to lay this matter on the table for further information was adopted
<br />and by the following vote

<br />Nays: Smith

<br /> 58-93 "I am submitting an A~nendmen~ to Section 24-83 of the Code of the City of
<br />Portsmouth, Virginia 1951 and recommend that it be placed on its firs~ reading.
<br />
<br /> This Amendment merely clarifies a section of the City Code which is in
<br />conflict with a section of the Building Code~'
