coNSENT ~ September 23, ;1997 UNFINISHED BUSINESS - AGENDA ::2 t:1 97-248 - Rezoning and Use Permit: Motion by Mr. Robinett, and seconded byMr. Martin, to adopt the follo~ lng ordinance and resolution, approved at the September 9, 1997, Public Hearh ~g, and was adopted bY the following vote. 97-241 (b): "ZONING AMENDMENT ORDINANCE Z-97-09" 97-248 (c): ,'RESOLUTION GRANTING A USE PEPJVIIT TO MT. SINAI RZUA CHURCH FOR THE OPERATION OF A CHURCH AT 103 GUST LANE." WHEREAS, Mt. Sinai RZUA Church has made application pursuant to Secti~ ,n 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a church to be located at 103 Gust Lane, Ports nouth, Virginia, as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things requi~'ed to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia 1. That the use for which the permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Mt. Sinai RZUA Church is hereby granted a use permit pursuant to Seption 40-43.1 of the Code of the City of Portsmouth, Virginia (1988} for the operation of a church on property located at 103 Gust Lane, and being more particularly described as: U P-97-14 Beginning at the southwestern intersection of Gust Lane and Avondale Road thence west approximately 334 feet along the southern right-of-way line of Avondale Road to a point; thence south 140 feet to a point; thence east approximately 455.01 feet to a point; thence northwest 190.8 feet along the western right-of-way line of Gust Lane to the point of beginning.
