coNSENT <br /> <br />~ September 23, ;1997 <br /> <br /> UNFINISHED BUSINESS - <br /> <br />AGENDA <br /> <br />::2 t:1 <br /> <br />97-248 - Rezoning and Use Permit: <br /> <br /> Motion by Mr. Robinett, and seconded byMr. Martin, to adopt the <br />follo~ lng ordinance and resolution, approved at the September 9, 1997, Public <br />Hearh ~g, and was adopted bY the following vote. <br /> <br />97-241 (b): "ZONING AMENDMENT ORDINANCE Z-97-09" <br /> <br />97-248 (c): ,'RESOLUTION GRANTING A USE PEPJVIIT TO MT. SINAI RZUA <br /> CHURCH FOR THE OPERATION OF A CHURCH AT 103 GUST <br /> LANE." <br /> <br /> WHEREAS, Mt. Sinai RZUA Church has made application pursuant to <br />Secti~ ,n 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />granting of a use permit to operate a church to be located at 103 Gust Lane, <br />Ports nouth, Virginia, as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />requi~'ed to be done in connection with said application; and <br /> WHEREAS, the Planning Commission has recommended the granting of <br />said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia <br /> <br />1. That the use for which the permit hereinafter described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br /> residing or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the <br /> property or improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure <br /> compatibility with surrounding uses; <br /> <br />(d) <br /> <br />Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe <br />and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br /> Portsmouth Zoning Ordinance. <br /> <br /> 2. That Mt. Sinai RZUA Church is hereby granted a use permit pursuant <br />to Seption 40-43.1 of the Code of the City of Portsmouth, Virginia (1988} for the <br />operation of a church on property located at 103 Gust Lane, and being more <br />particularly described as: <br /> <br />U P-97-14 <br /> <br />Beginning at the southwestern intersection of Gust Lane <br />and Avondale Road thence west approximately 334 feet <br />along the southern right-of-way line of Avondale Road to a <br />point; thence south 140 feet to a point; thence east <br />approximately 455.01 feet to a point; thence northwest 190.8 <br />feet along the western right-of-way line of Gust Lane to the <br />point of beginning. <br /> <br /> <br />
