<br /> Motion of Mr. Smith that the Council request the Planning Commission to bring their
<br />proposed Capital Improvement prog-ram up to date and present it to the Council, was adopted.

<br /> 5S-S22 - The following bommunication from Judge W.H.W. Cassell was read:

<br /> "Mr. Robert R. Beaten who has been named as f~ssociate Judge is interested in serving as
<br />Special Justice tb handle lunacy commissions and it is, there£ore, requested that he be named to fill the vacanc'
<br />created by the resignation of John R. Porter, Jr.'~
<br />
<br /> Motion of Mr. Walker that this recommendation be received and that it be considered,
<br />along with other matters, in a conference between the Council, City Manager, City Attorney and Judge Cassell, ws
<br />adopted.

<br />5S-324 - The following communication £rom Mr. Raymond E. Dunnavant was read:
<br />
<br /> "I wish to thank you for the confidence yon have in my ability and integrity by electin
<br />me Justice of the Peace for Jackson Ward on September 30th, 1955.
<br /> However, since this action was taken, I find the care o£ my business ia ac pressing
<br />that I will not have time to devote to the Office of Justice of the Peace for the City of Portsmouth and I feel
<br />this office should have ~he proper attention To uphold the dignity of this position. Therefore, I wonld like to
<br />decline this appointment . With my best wishes and success in the management of our City, I~am -

<br />On motion of Mr. Smith the resignation was accepted.

<br /> ~5S-325 - The ~ollowing letter from the Planning Commission was read:

<br /> "At the regular meeting of the Planning Commission at 52S Queen St., 3:30 P.M., October
<br />9, 1955, a letter of resignation by Mr. D.H. Sandie was submitted to the Planning Commission. The letter is as
<br />follows an~ I quote:

<br /> City Planning Commission,
<br /> - Portsmouth, Virginia.
<br />
<br /> Dear Sir:
<br /> The Mayor of the City of Portsmouth has demanded that I resign £rom the
<br />Planning Commission. It is his contention that my recent representation of Intervenora in the annexation Suit of
<br />the City of Portsmouth vs. Norfolk County is incompatible with my services to the City on the Planning Commission
<br />I believe, however, that he is motivated by other reasons: namely, complete control in one political family of
<br />every £unction of the municipal government of the City o~ Portsmouth. I can not subscribe to either his personal
<br />or political views and aspirations.
<br /> I was £i~st appointed to the Commission by Mayor Fre~ A. Duke and re-ap-
<br />@ointed by Mayor A.C. Bartlett to my present term which expires June l, 196Go My association with you and the
<br />oSher members of the Commission over the past several years has been most enjoyable and I trnst that my services
<br />have been satis£aetory to the Commission and the City o£ PortsmoutB. However, if it be the concensus of the mem-
<br />bers o~ theCommission that my services should be terminated, I hereby tender my resignation.

<br /> A motion was made that the Plm~ning Commission give Mr. D.H. Sandie a vote of con£idenc
<br />This motion was carried by a unanimous approval of the Planning Commission.
<br /> The Planning Commission also requested that Councilman R. Irvine Smith, the Council
<br />representative on the Planning Commission, ask the Honorable City Council for s vote of confidence concerning

<br /> Mr.-Smith, the Conncil's representative on the Planning Commission, spoke, stating that
<br />the Planning Commission, at its last ~eeting, had given Mr. Sandie ~ vote of confidence for his very valuable set
<br />Mice to the Planning Commission, he having given liberally of his time and effort to the work of the Commission,
<br />and the Planning Commission had requested that the City CounCil take the same action.
<br />
<br /> Motion of Mr. Smith that the City Council give Mr. Sandie a vote of confidence, acknow-
<br /> ledging his services to the Planning Commission, was lost, and by the following vote:

<br /> For: Bartlett, Smith
<br /> Against: Baker, Breedloye, Seward, Walker, Weiseman
<br />
<br /> In this connection, Mr. Breedlove was granted permission to rea~ a prepared statement
<br />opposition to the vote of confidence for Mr. Sandie, which ~s on file in the City Clerk's of£ice, and reads as
<br />f~llows:
<br /> "Mr.Pre~id~nS.~ the~present controversy surrounding Mr. Donald H. Sandie's position on
<br />the Portsmouth Planning Commission reqnires that further comment be made.
