It would re
quire fourteen signs which would make the total cost~ approximately $1~ 900.00. As there~ are no funds available
a% %his time, I recommend that thais be included in next year's budge~ for cohsideration."

Motion of Mr. Weiseman to concur in the recommendation of the City Manager was
adopted without dissenting vote.

58-381 - "The question of ~ending a financial statement with the-water bill to the
citizens of Portsmouth was referred to me at the last Council meetinM. Since there are many people who pay water1
bills that are net real estate owners and a large number of real estate owhers that do not pay water bills, I do
not-think this would be the best method to use. If s financial statement is to be sent, I believe it should be
done with the tax bill."
~otion of ~r. Broedlove that the report of the City Manager be received for inform-
tion ~as adopted, without a dissenting vote.

Motion of Mr. Weiseman that a financial 'statement of the City bel printed in the threei
Io c al papers, the Portsmout~ Star,- V%rginian Pilot and Journal and Guide, which statement will include Mr.
~a~ker's information, if it is found by the City ~nager ~o be correct, was adopted, without dissenting vote.

58-~82 - "The matter of the City Code being enforced with reference to School appro-~
priations, was ref~red to the City Manager knd City Attorney,
With reference to Section E-80 of the City Code, I understand that the
School Board has submitted annually the itemized report for expenditures to the City Manager.
This report co~f~rms to requirements of the State Board of Education, but
was noz coded to compare with the City Auditor's system of accounts.
It is the opinion of the Cit~ Attorney that this satisfies the require -
ments of Section ~-80 of the Code of the City of Portsmouth and Section ~-97 ~14) of the Code of Virginia.
It is also the opinion of the City, Attorney that~under the language of
Section 8-~ of the City Code, funds lawfully transferred by the City Auditor to the account of the School Board
cease to be.'~funds of the City', and are f~uds of the. School Board to be administered by the School Board as pre-
scribed by State law_and Section 2-81 of the City Code; therefore,Sections 8-3, 8-4, 8-14 and 8-40 of the City
Cod~hav~no application to such £unds, the handling and reporting ell such funds being covered by Section B-80 of
the C~ Code and applicable State laws. It is the opinion of the City Attorney that any major change in the sys
tem now P~e~ailing can only be accomplished by Charter Amendment or revision of the State statutes. This does not
apply to the merging of school purchases, preparation of vouchers or huild~ng and gnounds maintenance."

Motion of Ur. Smith to table the matter until the Council can secure further legal
~advice,\was adopted, and by the following vote:

Ayes: Baker, Bartlett, Seward, Smith, Weiseman
Nays: Breedlove, Walker

58-363 - "The question of combining the offices of the City Collector, Commissinner
of Revenue, License Inspector and City Treasurer has been considered by the City Attorney and the City Manager.
This is a partial report as the study, has not been completed. The com-
bining of these offices would mean that the City Collector's work of collecting and disbursing City funds would
he accomplished by the City Treasurer, while issuance of City licenses ~o~ld be performed by the Commissioner of
Revenue. It is the opinion of the City Attorney~ and myself that th~ State would not permit tko Constitutional
offices to collect Water Department funds or enforce the City license ordinance. It would also require a separ-
aze office fo~ the collection of delinquent taxes. It requires approval~by the State Compensation Board,'for
the operating budgets of Constitutional offices. TheSe budgezs must be filed before October ISth of each year.
