<br /> 58-359 - "I submit herewith an agreement between the ~ orfolk and Portsmouth Belt
<br />Line Railroad and the City of Portsmouth. This covers the installation of a storm drain under their tracks
<br />and right-of-way at a point 730 feet north of Deep Creek Boulevard. This storm drain is necessa~y to properly
<br />drain the L~incoln Park Housing project. I recommend that the proper city official~ be authorized to si~n this
<br />
<br />Motion o~ Mr. Weiseman to concur in t~e Manager'S recommendation was adopted, a~d by
<br />

<br /> 58-~80 - "At a previous Council meeting, it was referred to me to investigate the
<br />cost of having neon 'No Left Turn' siena installed at the High St. intersection where no left turns are permitted
<br />during certain hours.
<br /> The cos~ of these signs will be approximately. $1~$.00 each. It would re
<br />quire fourteen signs which would make the total cost~ approximately $1~ 900.00. As there~ are no funds available
<br />a% %his time, I recommend that thais be included in next year's budge~ for cohsideration."

<br /> 58-381 - "The question of ~ending a financial statement with the-water bill to the
<br />citizens of Portsmouth was referred to me at the last Council meetinM. Since there are many people who pay water1
<br />bills that are net real estate owners and a large number of real estate owhers that do not pay water bills, I do
<br />not-think this would be the best method to use. If s financial statement is to be sent, I believe it should be
<br />done with the tax bill."

<br /> 58-~82 - "The matter of the City Code being enforced with reference to School appro-~
<br /> priations, was ref~red to the City Manager knd City Attorney,
<br /> With reference to Section E-80 of the City Code, I understand that the
<br /> School Board has submitted annually the itemized report for expenditures to the City Manager.
<br /> This report co~f~rms to requirements of the State Board of Education,but
<br /> was noz coded to compare with the City Auditor's system of accounts.
<br /> It is the opinion of the Cit~ Attorney that this satisfies the require -
<br /> ments of Section ~-80 of the Code of the City of Portsmouth and Section ~-97 ~14) of the Code of Virginia.
<br /> It is also the opinion of the City, Attorney that~under the language of
<br /> Section 8-~ of the City Code, funds lawfully transferred by the City Auditor to the account of the School Board
<br /> cease to be.'~funds of the City', and are f~uds of the. School Board to be administered by the School Board as pre-
<br /> scribed by State law_and Section 2-81 of the City Code; therefore,Sections 8-3, 8-4, 8-14 and 8-40 of the City
<br /> Cod~hav~no application to such £unds, the handling and reporting ell such funds being covered by Section B-80 of
<br /> the C~ Code and applicable State laws. It is the opinion of the City Attorney that any major change in the sys
<br /> tem now P~e~ailing can only be accomplished by Charter Amendment or revision of the State statutes. This does not
<br /> apply to the merging of school purchases, preparation of vouchers or huild~ng and gnounds maintenance."

<br /> Motion of Ur. Smith to table the matter until the Council can secure further legal

<br /> 58-363 - "The question of combining the offices of the City Collector, Commissinner
<br />of Revenue, License Inspector and City Treasurer has been considered by the City Attorney and the City Manager.
<br /> This is a partial report as the study, has not been completed. The com-
<br />bining of these offices would mean that the City Collector's work of collecting and disbursing City funds would
<br />he accomplished by the City Treasurer, while issuance of City licenses ~o~ld be performed by the Commissioner of
<br />Revenue. It is the opinion of the City Attorney~ and myself that th~ State would not permit tko Constitutional
<br />offices to collect Water Department funds or enforce the City license ordinance. It would also require a separ-
<br />aze office fo~ the collection of delinquent taxes. It requires approval~by the State Compensation Board,'for
<br />the operating budgets of Constitutional offices. TheSe budgezs must be filed before October ISth of each year.
