Februarv 24th. 1959_ <br /> <br /> At a regular meeting of the City Council, held on February 24th, 1959, there were present~ <br /> <br />B. W. Baker, A.C. Bartlett, W;R. Breedlove, R. Irvine Smith, George R. Walker, <br />H. E. Weiseman, A.P. Johnson,Jr.,City Manager, and J,S.Livesay,Jr.,City Attorney. <br /> <br />The meeting was opened with prayer by Admiral W.W. Cummings, U.S.N. Retired. <br /> <br />Minutes of the regular meeting of Eebruary 10th, 1959 were read and approved. <br /> <br />The following reports from the City Manager were read: <br /> <br /> 59-49 - "I submit the following resolution and recommend its adoption. This resolution <br />consents to eneumbering interest of Ronney Associates in lease hold property on the north side of High St. This <br />is the property that the City leased for ninety-nine years renewable forever (part of the site of the former <br />Monroe Hotel). <br /> <br />"WItEREAS, the City of Portsmouth is the owner of a certain parcel of laud situated <br />on the north side of High Street, approximately 50 feet east of Court Street, with <br />a frontage on High Street of 130 feet, more or less, and a depth of 113 feet, more <br />or less, which said parcel of land is composed of four smaller parcels, which were <br />leased by the Trustees of the Town of Portsmouth to David A. Reynolds, Eliza Keenan, <br />William Bernard and William King, respectively, each for a germ of 99 years, renewable <br />forever, the rent under each of which said leases has been duly paid up to and includ- <br />ing the year 1959; and <br /> <br />WHEREAS, Ronney Associates, Incorporated xs now the.owner of the leasehold interests <br />created by said leases in the easternmost portion of the said parcel of land, with a <br />frontage on High Street of 82.19 feet, more or less, and a depth of 113 feet, more or <br />less, and the said Ronney Associates, Incorporated has made application to Massaohu- <br />setts Mutual Life Insurance Co. any, of Springfield, Massachusetts, for s loan of <br />$100,000.00, to be secured by a deed Of trust conveying its leasehold interests afore- <br />said, Together with other real estate owned by it; and <br /> <br />WHEREAS, the said Massachusetts Mutual Life Insurance Co~pany desires to obtain the <br />consent of the City o~ Portsmouth to the execution of a deed of trust on said lease- <br />hold interests, and the said Ronney Associates, Incorporated has made application to <br />the City for such consent; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, that the <br />consent of the City be, and it is hereby, given To the said Ronney Associates, Incor- <br />porated to encumber the leasehold interest of the said Ronney Associates, Incorporated <br />in the parcel of land above referred To, with a deed of trust to secnre to the said <br />~Lassachusetts ~Iutual Life Insurance Co. any the payment of a loan by it to the said <br />Ronney Associates, Incorporated in the principal amount of $100,000.00; but it is <br />expressly understood (1) that the City of Port smouth, by giving such consent, does got <br />release or relinquish any of its rights as lessor of the said property under the leases <br />from the Trustees of the To~n of Portsmouth hereinabove referred to, and (2) that such <br />consent shall not be construed as giving to the said Ronney Associates, Incorporated, <br />or its assigns or grantees, a fee simple estate in the said parcel of land." <br /> <br />On motinn of Mr. Walker, rules were suspended to hear from interested parties. <br /> <br />Mr. R.C. Barclay, Sr. ~poke. <br /> <br />On motinn of Mr. Weiseman, said resolution was adopted, without dissenting yore. <br /> <br /> 59-50 - "I submit the following resolution and recommend its adoption. This resolution <br />has been requested by an Anti-Pollution Conmlittee formed some months ago of the Cities of Norfolk,Portsmouth, <br />Newport News, Hampton~South Norfolk,Virginia Beach and the County of Princess Anne. <br /> This resolution approves the Anti-Polluti en Committee's recommendation thai a <br />Bill similar to the Anti-Pollution Bill in effect for New York ~arbor, be passed for the benefit of the harbor <br />of Hampton Roads." <br /> <br />"WHEREAS, a committee was formed some months ago known as the Anti-Pollution Committee <br />for the Hampton Roads area, the Cities of Norfolk, Portsmouth, Newport NewE, Hampton, <br />South Norfolk and Virginia Beach and the County of Princess Anne being represented on <br />this Committee, and <br />WHEREAS, the Anti-~ollution Committee, after long and careful study, obtained proper <br />resolutions from each of the aforementioned political subdivisions directed to their <br />respective Congressmen with the reques~ that a bill similar to the Anti-Pollution Bill <br />in effect for the New York harbor, be passed for the benefit of the harbor of Hmpton <br />Roads, its tributaries and beaches, and <br /> <br />WHEREAS, this Bill known as House Bill 11697 was passed a~ the 85th Congress, imposmng <br />upon the Corps of United States Engineers the duties of enforcement, and <br /> <br />WHERaFUkS, in the course of its study it was the considered opinion of the entire Com - <br />mittee that some provision should be made for an agency vested with the authority and <br />~-ith the necessary funds To provide garbage and fusel oil disposal for ships using the :~ <br />facilities of the Hampton Roads area, and <br /> <br />WHEREAS, the area To he served being comprised of several political subdivisions, it <br />is the opinion of this Council that this service shoRld be rendered by one au~horit~ <br /> <br />NOW, THEREFORE, BE IT RESOLVED thar the Council of the City of Portsmouth favors <br />necessary legislation authorizing the Division of Ports of the Department of Conservation <br /> <br /> <br />
