<br />Tract No. 1.
<br />
<br />Beginning at a point on the 14' contour marked by a stake, aaid point being on the
<br />property line between the herein described parcel and-the land of L.W. Caulk and
<br />located 134.0' N 44° 06' W from a pipe on the northwestern right of way line of
<br />Riverview Drive; thence, N 44° 06' W - 96.8' to a point; thence N 26° 52' W-76~
<br />to a point; thence N 38° 16' W - approximately 240' to Smith Creek; thence, north
<br />erly along the said edge of Smith Creek to a point; thence S 38° 16' E - approxi-
<br />mately 3t9', more or 'less, to a pzpe.; thence S 87° 04' E - 59.0' to a stake on
<br />the 14' contour; thence, along the 14' contour, as s~me is shown on the plat here-
<br />inafter mentioned, to the point of beginning.

<br />The hereinabove described parcel contains 0.65 acres, more or less, and. is bounded
<br />on the aorth by J.R. Ellison,Jr., on the east by the remaining laud of Lillia~W.Nor-
<br />Tleet, the purported owner of the tract to be acquired, on the south by L.W. Caulk
<br />aud on the west by Smith Creek.

<br />
<br />Beginning a~ a point on the t4' contour marked by a stake, said .point,being on the
<br />property line between W.G. Gobbel and F.W. Godwin :~md located 61.2' N 57° 01' W -
<br />of the western right of way line of Riverview Drives thence N 57° 01' W - approxi-
<br />mately 211' ~o Smith Creek; thence along the edge of Smith Creek to a point and the
<br />land of J.R. Ellison,Jr; thence S 44 01 E approximately 145' to a stake on the
<br />14' contour; thence, in a northerly direction along the 14' contour, as same is
<br />shown on the plat hereinafter mentioned, to the point of beginning.

<br />The hereinabovedescribed lot contains 0.34 acres, mere or 'less, and is bounded on
<br />the north by F.W. Godwin, on the east by the remai~zng land of W.G. Gobbel, the
<br />purported owner of the tract to be acquired, on the-south by J.R. Ellison,Jr., and
<br />on the ~west by~Smith Creek.

<br />Be it further resolved that the City Attorney is authorized and instrueted ~o
<br />institute condemn~tio~ proceedings, employing counsel of his choice therein, to
<br />acquire the aforesaid doropem.ty- rights for- the purposes of the Clty~
<br />
<br />-3~n~.-motio~ of-:~.J B~r~l~,- s~id-resolution was adopted, without dissenting votel
<br />
<br /> 5~9-100 ~ "I ~ submitting .the-attached resolution aud recommend its adoption. This
<br />resolution separatesthe office of d~linquent Tax Collector from the CityCollector, whieh is necessary at this
<br />time as we are currently auditing the taxes.
<br /> When this audit is complete, we want re be able to charge the delinquent
<br />taxes directly to the Delinquent Tax Collector.
<br /> By handling it inihis manner, it will eliminate the necessity of a detail
<br />audit at the end of June when~further changes are made in our Financial Department.
<br /> I will submit an ordinance at a later date to become effective July. lst,
<br />1959, covering the office of'Delinquent T~x Collector a~d all other Financial Departments of the City."

<br />On motion of Mr. Talker, said resolution was adopted, without dissenting vo~e.
