a petition therefor has been presented pursuant to Chapter X of the Charter. <br /> Therefore, I am of the opinion that the City Council may not adopt any ordinance <br />providing-for annual assessment .of real estate P~ier to June 10, 1960, unless it receives a petition for same <br />under Chapter X of the Charter and the proposition carries in an election of the people. After June 10, 1960 <br />there will be no legal impediment to action by City Council on the subject. <br /> The only other way to restore this system of assessment prior to June.10, 19~0, <br />would be to procure from the next regular session of the General Assembly a Charter ~mendment making the system <br />mandatory. I~:eould not recommend this as I know of no other city with such a mandatory provision and the time s~ <br />would be only several mnnths." <br /> <br /> Motion of Mr. Bartlett that this report be received as information, and filed as <br />such, was adopted, without dissenting vote. <br /> <br /> 59-95 - "The Southeastern Virginia Regional Planning and Ecomomic Development <br />Commissmon has requested that the City officially elect two members to represent the City of Portsmouth on this <br />Commiss~om. <br /> In November of 1957, the City Council elected Mr. R. Irvine Smith and <br />Mr. P~ul S. DuIauey to serve on a temporary committee~to develop the information necessary for the formation <br />of 1 this Commission. <br /> The Commission would now like to have the members appointed on a perma ~ <br />neat basis in order that they may~ be properly installed at,the Commission's meeting on April ,ZEnd, 1959. It is <br />proper To elect the members ~t this time." <br /> <br /> Motion of Nr. Smith to go into the election of two members to represent the City <br />of?Portsmouth on the Commission, was adopted. <br /> <br />Mr. Breedlove nomznated I/Ir. A.P. Jokuson, Jr. <br /> <br />Mr. Weiseman nominated Mr. R. trvine Smith to represent the City Council on the <br /> <br />Commission. <br /> <br />Motion of Mr. Bartlett that nominations beelosed was adopted. <br /> <br /> Vote being taken, Mr. Johnson was elected without disse~tin~ vote and Mr. Smith <br />was elected by the following vote: <br /> <br /> Ayes: Bartlett, Seward, Smith, Weiseman <br />Nays: Baker, Breedlove, Nalker. <br /> <br /> 59-9S - "I submit the following ordinance and recommend that it be placed on <br />first reading'. This ordinance mncreases it to $50.00. The present fee for opening <br />a grave is $25.00.
