<br /> "Be It Resolved by the City Council of the City of Portsmouth, Virginia,
<br /> in regular meeting assembled, that the Mayor of said City be, and he
<br /> hereby is, authorized to enter into an agreement with the ATLANTIC COAST
<br /> LINE RAILROAD COMPANY, and to sign same on behalf of said City, whereby
<br /> the said Railroad Company gives and grants unto the City of Portsmouth,
<br /> Virginia, the right to install And maintain, for the purpose of conducting
<br /> water, a line of 2 inch galvanized steel PiPe along the southeasterly portion
<br /> of the Railroad Company's right of way at or near Suffolk, Virginia, de -
<br /> scribed as beginning at a Point in an existing crossing belonging to said
<br /> City, covered by agreement dated October 10, 195S, between the said Railroad
<br /> ~Compauy and said City; running thence southwestwardly 350 feet, maintaining a
<br /> clearance of 45 feet ~outheastwardly, measured at Tight angles, from the cen-
<br /> ter line of the RAilroad Company's main track; thence southeastwardty 5 feet,
<br /> more or less, to the southeasterly boundary line of the Railroad Company's
<br /> right of way, which right of way is 50 feet wide on each side of said center
<br />
<br /> June 19, 1959, a copy of which agreement is filed with this City Council."

<br />allows the Seaboard Airline Railroad Company to lease to the contractor supplying material for the construction
<br />of the new Federal Building, land owned by the City and presently leased to the Seaboard Airline Railroad. Unde:
<br />our lease agreement with the Railroad~ it requires them to obtain permission for use of this land for anything
<br />other than freight operations."

<br /> ~'WHEREAS, the City of Portsmouth has leased to Seaboard AirLine Railroad
<br /> Company certain property as more fully described in that certain agreement
<br /> dated November 12, 1958, which said agreement provides that the leased
<br /> premises shall be used in connection with its freight operations and for
<br /> no'other purpose; and
<br /> WHEREAS, one or more subcontractors engaged in the construction of the
<br /> Federal Office Building at Crawford and L~ndon Streets will require ~em-
<br /> porary storage sites for materials and equip m~nt and it is advantageous
<br /> to all parties that the property of ~he City be made available for such
<br /> purposes. ~
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth,
<br />Virginia, that permission zs extended Seaboard Air Line Railroad Company to
<br />sublease portions of the hereinmentioned property for the purposes .expressed,
<br />provided that no such sublease shall be granted by the Railroad Company unless
<br />and until the terms of such sublease have been approved by the City M~nager and
<br />the City Attorney."
