November 27, 2001 <br /> <br /> (i) The facility shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official and shall promptly <br />correct any deficiencies noted. These shall include an initial inspection prior to <br />commencing operation and annual inspections thereafter. <br /> <br /> (j) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01-312(d): <br /> <br />1. Raleigh Harsley, 2124 Peach Street, spoke in opposition to the ordinances. <br /> <br />2. Richard Cleveland, 1731 Maple Avenue, spoke in opposition to the ordinances. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to waive the rules of <br />order to allow Mr. Allen to speak, and was adopted by unanimous vote. <br /> <br />3. Reginald Allen, 1421 Wilcox Avenue, spoke in opposition to the ordinances. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Pitts, to adopt the following <br />ordinances, approved at the November 13, 2001 meeting, and was adopted by the <br />following vote: <br /> <br />"ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 40-43.4(1), 40-52.1 (a) <br />AND TALES 40-43-1, 40-43.1-2, 40-43.1-3 AND 40-44-2 AND BY ADOPTING NEW <br />SECTIONS 40-162 AND 40-43.7 PERTAINING TO ZONING." <br /> <br />"ORDINANCE TO AMEND CHAPTER 33 OF T HE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 33-55(c)THEREOF <br />PERTAINING TO FINAL PLAT APPROVAL." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Holley <br />Nays: Whitehurst <br /> <br />- City Manager's Report - <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Pitts, to amend the City Manager's <br />Report adding two items, and was adopted by unanimous vote. <br /> <br /> Adoption of a motion to transfer $365,747 from the Grants Contingency Account <br />to fund the Drug Court Program. <br /> <br />Recommendation <br /> <br />· Adoption of a motion to transfer $365,747 from the Grants Contingency Account to <br />fund the Drug Court Program. <br /> <br />Purpose and Need: <br /> <br />· The U. S. Department of Justice has approved a Drug Court Program Grant to the <br />Circuit in the amount of $365,747 from 9/01/01 to 8/31/02 and $368,308 for 9/01/02 to <br />8/31/02. <br /> <br />· The Circuit Court Judiciary has requested the transfer of funds for this program and <br />it has been designed and implemented to serve as an intensive treatment program for <br />the purpose of treating non-violent felony offenders who are dependent upon drugs <br />and/or school. <br /> <br /> <br />
