<br />Financial Impact:
<br />
<br />· There is no adverse financial impact from reappropriation of the amount of funds
<br />encumbered at June 30, 2001 and the amounts unexpended in the operating and
<br />capital budgets, respectively as the amounts have been previously appropriated and
<br />funded.
<br />
<br /> Motion by Mr. Griffin, and seconded by Mr. Pitts, to adopt the following
<br />resolution, and was adopted by the following vote:
<br />
<br />"A RESOLUTION REAPPROPRIATING FISCAL YEAR 2001 FUNDS IN THE CITY
<br />AND SCHOOL BOARD OPERATING BUDGETS AND FOR PREVIOUSLY-
<br />AUTHORIZED CAPITAL IMPROVEMENT PROJECTS.
<br />
<br /> WHEREAS, Section 15.2-2506 of the Code of Virginia (1950) provides that local
<br />funds may not be paid out unless there has first been made an annual, seminannual,
<br />quarterly or monthly appropriation of such funds by the local government; and
<br />
<br /> WHEREAS, the appropriation of Fiscal Year 2001 Operating and Capital
<br />Improvement funds has expired; and
<br />
<br /> WHEREAS, Fiscal Year 2001 Operating Budget funds have been lawfully
<br />encumbered by the City and the School Board; and
<br />
<br /> WHEREAS, unexpended funds remain in Fiscal Year 2001 Capital Improvement
<br />funds from previously-authorized City, School Board, and Public Utilities capital
<br />improvement projects; and
<br />
<br /> WHEREAS, a reappropriation of the unexpended, but encumbered, Fiscal Year
<br />2001 funds and of the unexpended Capital Improvement funds is required in order to
<br />fulfill City financial obligations and to continue ongoing capital improvement projects
<br />without interruption.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />
<br /> 1. That the sum of $4,111,222 be reappropriated in the following Funds in
<br />the City Operating Budget from unexpended Fiscal Year 2001 funds to allow for
<br />payment of encumbrances outstanding at June 30, 2001:

<br /> 2. That the sum of $5,863,546 be reappropriated in the School Board
<br />Operating Budget from unexpended Fiscal Year 2001 funds to allow for payment of
<br />encumbrances outstanding at June 30, 2001; and
<br />
<br /> 3. That the sums of $36,033,465 for City Capital Projects and $8,381,012 for
<br />School Board Capital Projects be reappropriated in the Capital Improvement Fund from
<br />unexpended Fiscal Year 2001 funds for previously-authorized capital projects; and
<br />
<br /> 4. That the sum of $17,473,987 be reappropriated in the Public Utilities
<br />Capital Improvement Fund from unexpended Fiscal Year 2001 funds for previously-
<br />authorized capital projects.
