October 9, 2001 At a Regular Meeting of the City Council on Tuesday, October 9, 2001, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager Daniel M. Stuck, City Attorney Timothy Oksman. Councilman J. Thomas Benn III opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a Called Meeting on September 25, 2001, and a Regular Meeting on September 25, 2001, and was adopted by unanimous vote. 01 - 285 - Presentation: Proclamation presented to Lieutenant Dennis White for "D.A.R.E. Family Day". Lieutenant White also sang "America the Beautiful". Mayor Holley read a letter of Condolence for World Affairs from the Mayors of Portsmouth, England and Caen, France. - Public Hearing - 01 - 286 - Public hearing on use permit applications: (a) UP-01-15 WESTHAVEN NEIGHBORHOOD - Othella Madden and Monica Brembry request a use permit to operate a church at 3612 Turnpike Road. The property is zoned Commercial C-1. The Comprehensive Plan recommends commercial development of the area. Motion by Mr. Benn, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-01-15 be denied on first and final reading, and was adopted by the following vote: Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley Nays: None (b) UP-01-17 DOWNTOWN NEIGHBORHOOD - Tim and Shannon Woodland request a use permit for a dwelling unit in a mixed use structure at 300 High Street. The Comprehensive Plan recommends commercial development of the area. Motion by Mr. Pitts, and seconded by Mr. Moody, to concur with the recommendation of the Planning Commission that UP-01-17 be approved on first reading, and was adopted by unanimous vote. (c) UP-01-18 TRUXTON NEIGHBORHOOD - Mount Carmel Baptist Church requests a use permit for an addition at 3310 Deep Creek Boulevard. The property is zoned Historic Residential (HR). The Comprehensive Plan recommends single-family uses in this area. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-01-18 be approved on first reading, and was adopted by unanimous vote. (d) UP-01-19 RIVER POINTE NEIGHBORHOOD - Sheran Oliver requests a use permit for a family day home at 13 Pointe of View Arch. The Comprehensive Plan recommends single-family residential development of the area. Motion by Mr. Griffin, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that UP-01-19 be approved on first reading, and was adopted by unanimous vote.
