November 25 _1997 <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of <br />said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br /> residing or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the <br /> property or improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure <br /> compatibility with surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for <br /> parking, driveways, and curb cuts which will provide for safe and <br /> convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br /> Portsmouth Zoning Ordinance. <br /> <br /> 2. That Victor E. Cox is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />sale of used motor vehicle parts on property located at 3410 George <br />Washington Highway, and being more particularly described as: <br /> <br />UP-97-19 <br /> <br /> Beginning at a point approximately 140 feet <br />Northwest of the intersection of George Washington <br />Highway and Frederick Boulevard; thence northwest <br />along the northern right-of-way line of Frederick <br />Boulevard approximately 186 feet; thence continuing <br />in a northwesterly direction 246 feet; thence in a <br />Northeasterly direction approximately 392 feet; <br />thence in a southeasterly direction approximately <br />100 feet;thence in a northeasterly direction <br />approximately 100 feet; thence in a southeasterly <br />direction approximately 100 feet; thence in a ' <br />southwesterly direction approximately 304 feet; <br />thence in a southeasterly direction approximately <br />185 feet; thence in a southwesterly direction <br />approximately 47 feet; thence ina nOrthwesterly <br />direction approximately 180 feet; thence in <br />a southwesterly direction approximately 313 feet; <br />thence continuing in a southWesterly direction <br />approximately 37 feet to the point of beginning at <br />the northern right-of-way line of Frederick Boulevard. <br /> <br /> 3. That this use permit is approved Subject to the folloWing <br />conditions: <br /> <br />(a) Prior to the storage of any vehicles on the site, the applicant <br /> shall establish evergreen vegetative screens both on the <br /> property and around the perimeter of the property as shown on <br /> Exhibit A. The <br /> vegetative screens around all storage yards must be maintained <br /> at a height no less than 8 feet. <br /> <br /> <br />
