March 13, 2001 <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, <br />VIRGINIA: <br /> <br /> The City Manager and the Chief Financial Officer of the City, or either of them, is <br />hereby authorized and directed to execute the Amendment in a form acceptable to the <br />officers, or either of them; provided, however, that the Amendment shall provide for <br />payments under the Cooperation Agreement that are equivalent to an amended Note <br />(a) having a principal amount not exceeding $10,000,000, (b) maturing no later than <br />September 30, 2001, (c) having a "true" or "Canadian" interest cost not exceeding 9.0% <br />per year, and (d) being subject to optional redemption at a premium not exceeding 3%. <br /> <br /> Following the execution of the Amendment, the City Manager shall file a <br />certificate with the City Clerk setting forth the terms of the Amendment and the amended <br />Note. The actions of the City Manager in approving, executing and delivering the <br />Amendment shall be conclusive, and no further action shall be necessary on the part of <br />the City. <br /> <br /> The City Manager, the Chief Financial Officer of the City and the City Attorney <br />and such other officers as they shall designate are authorized and directed to execute <br />and deliver all certificates and instruments and to take all actions necessary or desirable <br />in connection with the execution and delivery of the Amendment. <br /> <br /> All other actions of the officers of the City that are in conformity with the purposes <br />and intent of this Resolution and in furtherance of this financing and the undertaking of <br />the Project are approved, confirmed and ratified. <br /> <br /> Except as supplemented by the terms of this Resolution, the Prior Resolution is <br />hereby approved, confirmed and ratified." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 88 - Adoption of a motion to transfer $111,684 from the Grants Contingency <br />Account for the Virginia Exile Program. <br /> <br />The Department of Criminal Justice Services has awarded this grant to the City <br />for the Commonwealth's Attorney's office, and it will be used for prosecuting <br />persons charged with illegally possessing and using firearms and for promoting <br />community awareness efforts aimed at deterring gun violence. <br /> <br />Recommendation: <br /> <br />· Adoption of a motion to transfer $111,684 from the Grants Contingency Account for <br />the Virginia Exile Program. <br /> <br />Purpose and Need: <br /> <br />· The Department of Criminal Justice Services has awarded this grant to the City of <br />Portsmouth for the Commonwealth's Attorney's office. <br /> <br />· The Exile Program's primary focus is to reduce gun violence and homicides by: <br />identifying and aggressively prosecuting persons charged with illegally possessing and <br />using firearms using newly strengthened state law and bail procedures; and organizing <br />community-based and community supported public awareness efforts aimed at <br />deterring gun violence by highlighting enhanced enforcement/prosecution efforts and <br />the certainty of punishment upon conviction. <br /> <br /> <br />
