<br />"WHEREAS, His Excellency, Governor J. Lindaay Almond, Jr. did on
<br />April 19th, 1961, declare the week of May ~l as Highway Week in
<br />'~irg~n3l~ for the purpose of publicizing the highway building program
<br />of the ~ommonwealth of Virginia and thereby advance public awareness
<br />and understanding of this program and its objectives, and
<br /> WHEREAS, this highway program has reached record proportions and is
<br />deemed necessary to provide Virginia citigens and visitors the safes~
<br />and best ~ransportation available, and
<br /> WHEREAS, the need for such a program of construction, improvements and
<br />maintenance has not received the public a~tention it deserves and re -
<br />quires if citizen support of the Department's goals is ~o be achieved
<br />and sustained, and
<br /> WHEREAS, observance of Highway Week in Vfrginia during May 21-27
<br />affords an oL~portunity to coincide activity with National Highway Week,
<br />with the suppor~ of the Congress of the United States and the President
<br /> NOW, THEREFORE, BE IT RESOLVED, that this Highway ~ommission fully
<br />endorses the action of the Governor and urges personnel of the Highway
<br />Department and all Virginia citizens rd observe and recognize Highway
<br />Week in,,Virgin~a, May 21-27, through appropriate proceedings and cere-

<br />Be it ordained by the Council of the City of Portsmouth, V%rginia, that
<br />Section 8-1.6 of the Code of the City of Portsmouth, Virginia, 1951, hs
<br />amended, be amended and reordained to read as follows:

<br />Section 8-1.6. Fiscal year and lapse of appropriations.
<br />
<br />The fiscal year for the City shall begin on the firsz day of January of each year,
<br />beginning with January 1, 1962. All appropriations shall lapse a~ the end of the
<br />period for which they were made, ~o the extent they shall not have been expended
<br />or lawfully encumbered.'

<br /> "I submit the attached ordinance for your consideration and possible action. This or-
<br />dinance changes the fiscal year of the City from July 1st to ~a~Rary 1st of each year. The prime result of such
<br />change would be ~o bring together fhe dates for establishing the tax rate and the budget as prescribed by law and

<br />Law - Chapter 1~, Section 58-844 of the Code of Virginia is quoted the council of every c'ity and ~own shall
<br /> annually cause Ed be made up and entered on their journals an account of all sums lawfully chargeable on the
<br /> city or town which ought to be paid within one year and order a city or uown levy of so much as in their
<br /> o~pinion is necessary Uo be raised in tha~ way mn addition to what may be received for licenses and from

<br />Section 15-575 of the Code of Virginia is quoted, "At lease 30 days przor to the time when the annual tax
<br />levy is made, the Board of Supervisors or the Councils of the cities and towns shall prepare . . .

<br />Chapter IV, Section 32 of the Charter of the City of Portsmouth is quoted, "For the execution of its powers
<br />and duties, the City Council may raise annually, by taxes and assessments in said city, such sums as they
<br />shall deem necessary ~o defray,the expenses of and for the purposes of said city."

<br />Logic~A tax rate levied six months after, or before (your choice) the budget is approved comes out of thin air,
<br /> is without foundation, and is of no effect except to stabilize the. denominator. At this mid-point between
<br /> two budgets it is too late to apply it to the estimates of the current year and too early to apply it to the
<br /> unknown requirements of the following year."

<br />be directed to take the aecessary step~ to change the proposed budget for the fiscal year 1961-62 as necessary,
