June 13th~ 1961 <br /> <br />without dissenting vote: <br /> <br />On motion of Mr. Barnes, the following ordinance was approved on first reading, <br /> <br />"AN 0RD~NANCE TO APPROPRIATE $1,286,385.00 FROM THE GENERAL CAPITAL <br />IM~ROVEMENT FUND FOR THE PURPOSES OF BOND RETIREMENT, INTEREST AND <br />HANDLING CHARGES, NORFOLK COUNTY LITERARY FUND PAYMENTS AND DRAINAGE - <br />CURBS AND GUTYERS" <br /> <br /> 61-150 - "I submit the attached ordinance and recommend.that it be placed on first <br />reading. This ordinance establishes a new rap charge for service lines installed ~o the wa~er mains. <br /> <br />Motion of Mr. Barnes to approve the following ordinance on firsz reading: <br /> <br />'~N ORDINANCE TO AMEND SECTION 24-55 OF THE CODE OF THE CITY OF PORTSMOUTM, <br />VIRGINIA, 1951, AS A~ENDED, SO AS TO PROVIDE NEW RATES FOR TAP CHARGES FOR <br />CONNECTIONS TO WATER MAINSOF THE CITY OF PORTSMOUTH" <br /> <br /> Motion of Mr. Walker that the ordinance be amended by adding a new section <br />preceding the emergency clause, as follows, was lost, there being no second: <br /> <br />"The increases in this ordinance shall be effective only for the duration <br />of the next ensuing fiscal year after the effective date of this ordinance <br />after which period of time the rares for such services shall revert to the <br />rates in effect as of this date unless extended for another year by majority <br />vote of Council." <br /> <br />immediatel~ <br /> <br /> Mr. Walker made the following statement: <br /> <br /> "I wish the record of Council ~o show that, mn my opinion, this ordinance to amend <br />Section 24-55 of the Code to increase the tapping charges is not a temporary measure ro provide a ~emporary one-i <br />year increment of approx. $500,000.00 required to balance this year's budget, but is, and is intended to be, a <br />permanent increase to provide additional revenue for each succeeding year thereafter. It actually is intended <br />raise the annual take, rather than this year's revenue, and provide its parr of the cost of bigger government for <br />this year and subsequent years. This action defies the procedure clearly spelled ou~ in Bections 58-844 and <br />15-575 of the Code of Virginia and our City Charter. It defeats the intent of the law which, was to arouse the <br />attention of those having an equity in the city, the real estate owners, whenever government got so big it <br />couldn'~ pay its keep. It circumvents and nullifies the lawful rights of the Eaxpayer ro chop his government <br />dova~ in size annually by exercising his ax on the ~ax rate." <br /> <br /> Vote being taken on Mr. Barnes' motion, the ordinance was approved on first reading <br />and by the following vote: <br /> <br />Ayes: Smith, Barnes, Breedlove, Leafy, Seward, Weiseman <br />Nays: Walker <br /> <br /> 61-151 - "I submitflhe a~rached ordinance and recommend that it be placed on first <br />reading. This ordinance amends the Code to provide a new water rate for the City of Portsmouth and the City of <br />Suffolk. and for the counties of Norfoli and Nansemond.
