Ellis, Jr." <br /> <br />Ayes: Smith, Atkinson, Barnes, Dillon, Leafy <br />Nays: Walker. <br /> <br /> Mr. Walker stated he could not support the resolution because it does no~ comply with <br />Section 1-7 of the Code. <br /> <br />UP 2-62 - Application of City of Portsmouth for Use Permit - Sewer Pumping Station, <br /> <br />Greeneland Boulevard <br /> <br />On motion of Mr. Barnes, the following resolution was adopted and by the following vote: <br /> <br />"WHEREAS, the City of Portsmouth, by its City Attorney, has filed an application <br />pursuant to Section 4-2 of-t-he Zoni~ O~dinhnce o'f the City of Portsmouth, 1961, ..... <br />for the granting of a use permit as hereinafter described; and <br /> WHEREAS, the applicant, the Planning Director and the City Manager have done all <br /> things required to be done in connection with ssid applicstion, and the Planning <br /> Commission has recommended the granting of ssid use permit. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> A. That the use for which the use permit hereinafter described is sought (1) will <br /> not adversely affect the health or safety of persons residing or working in the <br /> neighborhood of the proposed use. (2) will not be detrimental to the public welfare <br /> or injurious co property or improvements in the aeighborhood, and (3) will be in <br /> accord with the purposes of said Zoning Ordinance. <br /> B. That the City of Portsmouth is hereby granted a use permit, pursuant to Section <br /> 4-2 of said Zoning Ordinahce, for the construction snd operation of s sewer pump- <br /> ing sEation to be located~ upon~property purchased from Mike Smith situate on the <br /> west side of Greeneland Boulevard, in the northern half of Lot'S", plat of A. B. <br /> Greene p~operty." <br /> <br /> Ayes: Smith, Atkinson, Barnes, Dillon, Leary <br /> Nays: Walker. <br /> <br /> Mr. Walker stated that he could not support the resolution because it does not comply <br />with Section 1-7 of the Code. <br /> <br />The following reports from the City Manager were read: <br /> <br /> 62-8 - "I submit the attached ordinance and recommend it be placed on first reading. This <br />provides for the assessment of new buildings substantially completed on~a .quarterly basis. It also allows for the <br />abatement of levies on a quarterly basis of buildings razed or destroyed." <br /> <br />On motion of Mr. Leafy, the following ordinance was approved on firs5 reading, without dis- <br /> <br />senting vote: <br /> <br />"AN ORDINANCE TO A~END ARTICLE IV (E) OF CHAPTER 8 OF THE CODE OF THE <br />CITY OF--PORTSMOUTH, VtRGINIA~-~195~,L~Y ADDING~THEEETO A NEW SECTION <br />NUN~ERED SECTION 8-1.61.1, TO PROVIDE FOR ASSESSMENT OF N~ BUILDINGS <br />SUBSTANTIALLY COMPLETED AND FIT FOR USE, OCCUPANCY A/%rD ENJOYMENT, AND <br />FOR ABATEMENT OF LEVIES ON BUILDINGS RAZED OR DESTROYED OH DANLAGED BY <br />A FORTUITOUS HAPPENING BEYOND THE CONTROL OF THE OWNER, AS OF THE FIRST DAY <br />OF EACH QUARTER YEAR." <br /> <br /> 62-9 - "I ~ubmit the attached ordinance and recommend it be placed on first reading. This <br />appropriates $1,200,000.00 for construction of the incinerator and authorizes the issuance of bonds therefor. <br />This is requested To permit temporary borrowing until the bonds are issued. It also rescinds the previous appro- <br />priations thai ha~e been made for ~he construction of the incinerator." <br /> <br />On motion of Mr. Leary~ the following ordinance was approved on first reading, without dis- <br /> <br />senting vote: <br /> <br />"AN ORDINANCE APPROPRIATING THE SU~ OF $1,200,000.00 TO COVER THE COST <br />OF PROVIDING A NEW INCINERATOR, AUTHORIZING AN ISSUE OF BONDS THEREFOR, <br />AND REVOKING PRIOR APPROPRIATIONS THEREFOR IN THE TOTAL SU~ OF $1,191, <br />500.00" <br /> <br /> 62-10 - "I submit the attached ordinance and recommend it be placed on first reading. This <br />authorizes the conveyance of a parcel of land to the Atlantic and Danville Railway Company to carry out exchange <br />of land in accordance with s written agreement dated February llth, 1955. This agreement was for the relocation <br />of a spur track in connention with the construction of Frederick Boulevard near the incinerator site.
