Pritchard, Jr., to use my name on the petition.his representative presented to the Portsmouth Plan- <br />ning Commission at.the PMblic Hearing held on January 5, 1962, and had I been asked to sign a petition o~ <br />Pritchard's behalf, I would hav~ refu~ed. T~is statement further certifies that I signed the aforementioned peti- <br />tion about t~ years ago only as a personal favor to Mr. E. T. Gresham, the owner of the Flagship restaurant. It <br />was not my intention at that time to help Mr. Pritchard in any manner. Since my official duties and responsibili- <br />ties with the Seaboard Airline Railroad require me to be absent from this city except on weekends, I will be unable <br />to attend the public hearing in the council chamber on Tuesday evening January the 23rd. I therefore take this <br />means of expressing my wholehearted opposition to the application for a use permit for Mr. David A. Pritchard, Jr. <br />Signed: T. DeLoatche spoke against the application. <br /> <br />Motion of Mr. Dillon that the Use Permit be denied Mr. Pritchard was lost and by the <br /> <br />following voEe: <br /> <br />Ayes: Dillon, Walker <br />Nays: Smith, Atkinson, Barnes, Leery. <br /> <br />On motion of Mr. Barnes, the following resolution was adopted and by the following <br /> <br />vote: <br /> <br />"WHEREAS, David A. Pritcherd, Jr., has filed an application pursuan~ to Section <br />4-2 of the Zoning 0rdinanee of the City of Portsmouth, 1961, for the granting <br />of a use permit as hereinafter described; and <br /> WHEt~EAS., the applicant, the Planning Director and the City Manager have done <br /> all things required to be done in connection with said application, and the <br /> Planning Commission has recommended the granting of said use permit, subject <br /> co the conditions hereinafter stated. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br /> Virginma: <br /> A. That the use for which the use permit hereinafter described is sought <br /> (1) will not adversely affect the health or safety or persons residing or <br /> working in the neighborhood of the proposed use, (2) will no~ be detrimental <br /> ro the public welfare or in3urlous Eo. property or improvements in the neigh- <br /> borhood, and (3) will be in accord with the purposes of the :said Zoning Ordi- <br /> <br /> H. That David A. Pritchard, Jr., his heirs, successors and assigns, is hereby <br /> granted a use permit, pursuan~ to Section 4-2 of said Zoning Ordinance, for the <br /> construction, qperation and maintenance of four boat slips and ten off-sEreet <br /> parking spaces as shown on the amended site plan attached hereto and made a <br /> par~ hereof, near the foot of Constitution Avenue, for a period of twenty (20) <br /> years, subject at all times to revocation by this Council for failure to com- <br /> ply with the folloRlng conditions deemed necessary to assure that the use <br /> permit hereby granted will conform to the requirements of said Zoning Ordi- <br /> nance, and that it will continue to do so: <br /> (1) That the driveway and parking lot ~hown on said amended site plan <br /> be improved and maintained with respect Lo pavement, markings, drainage facil- <br /> ities, shrubbery, and bumper guards ~o the satisfaction of the Director of <br /> Public Works; <br /> (2) That outdoor lighting be shielded away from any adjoining residence; <br /> (3) That Portsmouth public safety officials shall have the specific <br /> right at any time to enter upon said driveway and parking lot, for purposes <br /> of inspections; <br /> (4) Thaf maintenance and replacement of this bulkhead, finger pmers <br /> and pilings shall be limited to that shown on the said amended site plan." <br /> <br />Ayes: Smith, Atkinson, Barne~, Leery <br />Nays: Dillon, Walker. <br /> <br />UP 1-62 - Application of City of Portsmouth for Use Permit - Sewer Pumping Station, <br /> <br />Elmhurst Lane. <br /> <br />On motion of Mr. Barnes, the following resolution was adopted and by the following <br /> <br />vote: <br /> <br />"WHEREAS, the City of Portsmouth, by its City Attorney, has filed an application <br />pursuant ~o Section~ 4-2 of the Zoning Ordinance of the City of Portsmouth, <br />1961, for the granting of a use permit as hereinafter described; and <br /> WHEREAS, the applicant, the Planning Director and the City Manager have done <br /> all things required to be done in connection with said application, and the <br /> Planning Commission has recommended the granting of said use permit. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br /> Virginia: <br /> A.
