<br />Motion of Mr Leafy to approve this application on first reading was
<br />
<br />62-13 - Petition of Elizabeth S. Kneas and George C. Norris.

<br />
<br /> The following letter from Robert F. Babb, Attorney, was read:
<br />
<br /> "I represent the parties petitioning for the rezonlng matters afore-
<br />mentioned. I am informed that Mr. Dixon, one of the property owners in these petitions, is ill and will not be
<br />available for the public hearing which the council will hold on Tuesday, May 22, 1962.
<br /> Please accept this letter as a request that this matter be continued
<br />for az least one month or until June 26. If it will be necessary for me to appear at the council meeting on the
<br />2gnd and make this request in person, please advise me so that I may be present.
<br /> I am forwarding a copy of this' letter to Mr.- Gilbert Swink, the
<br />attorney who represents the Highland Civic League and the Highland Park-Biltmore Civic League, so that he will

<br />Use Permit 62-4 - Petition of Sgt. William H Harrison Post #190, American
<br />
<br />On motion of Mr. Barnes, the following resolution was adopted, with-
<br />
<br />out dissenting vote:
<br />
<br /> "WHEREAS, the Sgt. William H. Harrison Post #190, American Legion
<br />Home, Inc., has filed an application pursuant to Section 4-2 of the Zoning Ordinance of the City of Portsmouth,
<br />1961, for the granting of a use permit as hereinafter described; and,
<br /> WHEREAS, the applicant, the Planning Director and the City Manager
<br />have done all things required to be done in connection with ~aid application, and the Planning Commission has
<br />recommended the granting of said use permit, subject to the conditions hereinafter stated.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Ports-
<br />mouth, Virginia:
<br /> A. That the use for which the use permit hereinafter described is
<br />sought (1) will not adversely affect the health or safety of persons residing or working in the neighborhood of
<br />the proposed use, (2) will not be detrimental to the public welfare or injurious to property or improvements in
<br />the neighborhood, and (3) will be in accord with the purposes of the said Zoning Ordinance.
<br /> B. That Sgt. William H. Harrison Post #190, American Legion Home,
<br />Inc., zs hereby granted a use permit, pursuant to Section 4-2 of said Zoning Ordinance, for the construction,
<br />operation and maintenance of a lodge, fraternal or social organization, not conducted primarily for gain, such
<br />use being a lawful existing use at the time the said application was made, on premises owned by the applicant
<br />an 2711 Peach Street, Portsmouth, Virginia, for a period not no exceed the useful life of the present structure
<br />situate thereon, subject at all times to revocation by this Council for failure to comply with the following
<br />conditions deemed necessary to assure that the use permit hereby granted will conform Eo the requirements of
<br />said Zoning Ordinance, and that it will continue Eo do so:
