28f <br /> <br />"AN ORDINANCE TO AMEND SECTION 26-37 OF THE CODEOF THECCITYOF <br /> PORTSMOUTH, VIRGINIA, 1961~ PERTAINING TO THE REFUND OF CONTRI- <br /> BUTIONS TOTHE PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM UPON ~- <br /> WITHDRAWAL OF DEATH OF MEMBER BEFORE RETIREMENT."~ : <br /> <br />"AN ORDINANCE TO AMEN~ THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA <br />1961, BY AMENDING SECTION 29-15 PERTAINING TO THE PAYMENT OF WATER <br />ANDSEWER BILLS; SECTION 29-42, PERTAINING TO WATER AND SEWER SERVICE <br />CONTRACT WHEN OWNER IS RESPONSIBLE FOR WATER USED BY TENANT; AND <br />SECTION 29-57, PERTAINING TO TURNING WATER SERVICE ON OR OFF, <br />PROVIDING A FEE THEREFOR, AbeD PROVIDING AN INSPECTION FEE WHEN <br /> WATER SERVICE IS TURNED ON BY AN UNAUTHORIZED PERSON," <br /> <br />"AN ORDINANCE TO AMEND SECTION 31-44 OF THE CODE OF THE CITY OF <br /> PORTSMOUTH, VIRGINIA, 1961, TO PROVIDE THAT THE BUILDING SETBACK <br /> LINE ON THE TMELMAR LANE SHALL EXTEND FROM LAMPER ROAD T0 THE <br /> WESTERN CITY LIMITS." <br /> <br /> 62-233 - "I submit the sltacked ordinance and recommend thatit be placed on first reading. <br /> This ~mends Section 29-134 of the Code of the City of Portsmouth, Virginia, 1961, <br />to incorporate amendments to the State Plumbing Code adopted by the State Board of Health on May 17, 1962. <br /> In adopting the new City Code of 1961, the State Plumbing Code was adopted by <br />reference, but after receiving copies of the State Plumbing Code, it was found that amendments had been made to <br />this code To be effective July 1, 1962. <br /> This makes it necessary that we adopt this Ordinance." <br /> <br /> On motion of Mr. Eastes, the foliowing ordinance was approved on first reading: <br /> <br />"AN ORDINANCE TO AMEND SECTION 29-134 OF THE CODE OF THE CITY OF <br /> PORTSMOUTH, VIRGINIA, 1961, SO AS TO ADOPT AMENDMENTS TO THE <br /> STATE PLfffMBING CODE ADOPTED BY THE STATE BOARD OF HEALTH ON <br /> MAY 17, 1962.- <br /> <br />62-234 - "I submit the attached Ordinance and recommend that it be placed on first reading. <br /> This closes a portion of Westmoreland Avenue between the ~uth line of Bart Street <br /> <br />and a line 108~ feet south thereof. <br /> This closing has been requested by <br />approved by the Planning Commission." <br /> <br />the abutting properzy owners and has been <br /> <br />On motion of Mr. Barnes, the following ordinance was approved on first reading: <br /> <br />AN ORDINANCE TO CLOSE THAT PORTION OF WESTMORELAND AVENUE <br />BETWEEN THE SOUTH LINE OF BART STREET AND A LINE ONE HUNDRED <br />EIGHT AND ONE HALF FEET SOUTH THEREOF." <br /> <br /> 62-235 - "I submit the attached ordinance and recommend that it be placed on first reading. <br /> This ordinance closes a portion of Cumberland Avenue between the south line of <br />Clifford Street and the northwest line of Airline Boulevard. <br /> This closing has been requested by the abutting property owners and has been <br />approved by the Planning Commission. <br /> <br /> On motion of Mr. Barnes, the following ordinance was approved on first reading: <br /> <br />"AN ORDINANCE TO CLOSE THAT PORTION OF CUMBERLAND AVENUE BETWEEN <br /> THE SOUTH LINE OF CLIFFORD STREET AN]) THE NORTHWEST LINE OF <br /> AIRLINE BOULEVARD." <br /> <br />UNFINISHED BUSINESS <br /> <br /> 62-215 - The Comprehensive Plan df the City which was ~eferred to a conference of the <br />Council, at the last regular ~eeting, was presented. <br /> <br /> On motion of Mr. Knight, the plan was unanimously adopted, with an expression of thanks to <br />the Planning Commission for a job ~etl done. <br /> <br />taken up: <br /> <br />62-176 - The following ordinance, om which action was deferred until <br /> <br /> "ZONING AMENDMENT ORDINANCE 1962-i5." <br /> <br />this meeting, was <br /> <br />On m~tion of Mr. Knight, the ordinance was adopted smd by the following vote: <br /> <br />Ayes: Smith, Atkinson, Barnes, Dillon, Eastes, Knight, Leafy. <br />Nays: None <br /> <br /> 62-222 - Motion of Mr. Leafy to defer action on the election of a representative on the <br />Tidewater Airport Commission until the next meeting of the Council, was adopted, without dissenting vote. <br /> <br />NEW BUSINESS <br /> <br />62-236 - The following petition was read: <br /> <br /> "It has come to our attention that the City Bus Company located at Victory Blvd. and <br />Smithfield Road has acquired additional land fronting on Smithfield Road which has been zoned Type A residential <br />and are now in the process of leveling same possiblF for conversion to stowage, parking, etc <br /> <br /> <br />
