' March 24; ~I998 325 WHEREAS, Jill and: Mark' GA~'~- have made*application pursuant to Section 40-43.1 of the COde of the City of. Portsmouth, Virginia (1988) for the granting of a use permit to operate a bed and breakfast inn to be located at 500 Broad Street, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicants and the Planning Director haVe done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions; NOW, THEREFOREi, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter,described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Is compatible with and will not adversely affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources; (d) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (e) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (f) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Jill and Mark Cave are hereby granted a use permit pursuant, to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a bed and breakfast inn to be located at 500 Broad Street, being more particularly described as: UP-98-01 Beginning at the southwestern corner of Broad Street and ClevelaRd Street; thence, southeast along the western right-of-way line of Broad Street 120 feet; thence, southwest 140 feet to an alley; thence northwest along said alley 120 feet to the southern right-of-way of Cleveland Street; thence, northeast along said right-of-way 140 feet to the point ~.of beginning. The property is also known as Lots 681, 682 & 683, Map of Port Norfolk Land Company. 3. That this use permit is approved subject to the following conditions: (a) Unless otherwise provided herein, the inn shall be operated in accordance with a letter dated January 6, 1998, from Jil Cave to the Planning Commission, identified as Exhibit A and made a part hereof. (b) No more than three bedrooms shall be used for the inn.
