' March 24; ~I998 325 <br /> <br /> WHEREAS, Jill and: Mark' GA~'~- have made*application pursuant to <br />Section 40-43.1 of the COde of the City of. Portsmouth, Virginia (1988) for the <br />granting of a use permit to operate a bed and breakfast inn to be located at 500 <br />Broad Street, Portsmouth, Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicants and the Planning Director haVe done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of <br />said use permit with conditions; <br /> <br /> NOW, THEREFOREi, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter,described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br /> residing or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to the <br /> property or improvements in the neighborhood; <br /> <br />(c) <br /> <br />Is compatible with and will not adversely affect or be <br />materially detrimental to adjacent uses, residents, buildings, <br />structures, or natural resources; <br /> <br />(d) Will be provided with sufficient landscaping to insure <br /> compatibility with surrounding uses; <br /> <br />(e) <br /> <br />Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe <br />and convenient traffic movement; and <br /> <br />(f) Will be in accordance with the purposes of the City of <br /> Portsmouth Zoning Ordinance. <br /> <br /> 2. That Jill and Mark Cave are hereby granted a use permit pursuant, to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />operation of a bed and breakfast inn to be located at 500 Broad Street, being <br />more particularly described as: <br /> <br />UP-98-01 <br /> <br />Beginning at the southwestern corner of Broad Street and ClevelaRd <br />Street; thence, southeast along the western right-of-way line of Broad <br />Street 120 feet; thence, southwest 140 feet to an alley; thence northwest <br />along said alley 120 feet to the southern right-of-way of Cleveland Street; <br />thence, northeast along said right-of-way 140 feet to the point ~.of <br />beginning. The property is also known as Lots 681, 682 & 683, Map of <br />Port Norfolk Land Company. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) <br /> <br />Unless otherwise provided herein, the inn shall be operated in <br />accordance with a letter dated January 6, 1998, from Jil Cave to <br />the Planning Commission, identified as Exhibit A and made a part <br />hereof. <br /> <br />(b) No more than three bedrooms shall be used for the inn. <br /> <br />(c) <br /> <br />The applicants shall keep a guest register of all <br />make the register available for inspection <br />Portsmouth at any time. <br /> <br />guests and sh;all <br />to the City of <br /> <br /> <br />
