<br />At a regular meeting of the City Council, held on July 23, 1963, there were present:

<br />g. Irvine Smith, C. S. Atkinson, John L. Dillon, George D. Eastes, L. L. Knight, A. P. Johnson, Jr.,
<br />and M. A. Korb, Jr., City Attorney.
<br />
<br />The meeting was opened with prayer by Mr. Eastes.
<br />
<br />Minutes of regular meeting of July 9, 1963, were.read and approvedk
<br />
<br />63-166 - Public Rearing on Zoning petitions.
<br />
<br />Zoning Petition Z 63-20 - Joe A. and Toby E~ Freedman.
<br />
<br />John-.A..MacKenzie, attorney, spoke for the petition._
<br />
<br /> Motion of Mr. Dillon to concur in the recommendation of the Planning Commission and to approve the
<br />following ordinance on first reading was adopted, without dissenting vote:
<br />

<br /> Zoning Petition Z 63-21 - Fannie and Vsnnie H. Pool.
<br />
<br /> Motion 'of Mr. Atkinson to concur in the recommendation of the Planning Commission to deny the appli-
<br />cation was adopted, without dissenting vote.
<br />
<br />UP 63-2 - Petition of Peck Iron and Metal Company.
<br />
<br />The Manager presented s communication requesting that this petition be withdrawn.

<br />UP';63~3- Petition of Portsmouth Iron and Metal Co., Inc.
<br />
<br /> Motion_of Mr. Knight that the permit be granted and that the following resolution be approved, was
<br />adopted, without dissenting vote:
<br />
<br /> "WHEREAS, Portsmouth Iron and Metal Company, Inc., has filed an application pursuant to Section 4-2
<br />of the Zoning Ordinsnce of the City of Portsmouth, 1961, for the granting of a use permit as ~hereinafter described;
<br />and
<br /> WHEREAS, the applicant, the Planning Director and the City Manager have done all things required to
<br />be done in connection .with .said application, and the Planning Commission hms recommended the granting of said use
<br />permit.
<br /> NOW THEt~EFORE, .BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br /> A. That the use for which the use permit hereinafter described is sought (1) will not adversely
<br />affect the health or :safety of persons residing or working in the 'neighborhood of the ~roposed use,
<br />be detrimental to the public welfare or injurious to property or improvements in the neighborhood, and (3) will
<br />be in accord with the purposes of sa~id Zoning Ordinance.
<br /> B. That the use permit hereinafter granted shall be subject to the following conditions:
<br /> ~..& .... That the applicant.~comply with the previsionsof Section 4=3 (150) of the Zoning Ordinance.
<br /> 2. That the street side of the premises be landscaped with shrubbery.
<br /> 3. That all open fires dn the premises-are prohibited and all burning must'be confined to
<br /> incinerators approved by the Portsmouth Fire-Department.
<br /> C. That Portsmouth Iron and.Metal Company, Inc., is hereby granted a use permit, pursuant to Section
<br />4-2 of said Zoning Ordinance, for the construction and operation of s junk and wrecking yard to be rocated on the
<br />property described ss follows: Beginning approx. 150' W of the NW corner of Turnpike Road. and Confederate Avenue
<br />at the W right-of-way line of an alley, thence N along said line approx. 340', thence-W approx. 137[ to the E
<br />right-of-way line of the Norfolk & Portsmouth Belt Line Railroad, thence S along said line approx. 425' to the N
<br />right-of-way line of Turnpike Road, thence NE along said right-of-way line 148' ~o the point.of .beginning; also,
<br />beginning on the S right-of-way line of Turnpike Road 336.6' SW of Spruce Street, thence along said .line 150',
<br />thence SE approx. 140~ re a rear lot line, thence NE along said line 150~ to a side lot line, thence NW approx.
<br />125' to the point of beginning.

<br /> The following communications fnom the City Manager were read:
<br />
<br /> 63-167 - "I submit the attached Ordinance and recommend it be placed on first reading.
<br /> This appropriates $~5,000JO0 in the Annexation Bond Fund for the completion of.the Simonsdale
<br />sewers
<br /> There has been appropriated $686,000.00 previously to cover the contracts on this project. The
<br />shove amount will complete the payment to the contractor for the work and for engineering services performed by
<br />the consulting engineers:."
<br />
<br /> On motion of Mr. Esstes, the following ordinance was spproved on first reading:
<br />
<br /> "AN ORDINANCE TO APPROPRIATE $?5,000.00 FROM THE ANNEXATION BOND. FUND (SEWERS) FOR THE PURPOSE OF
<br /> CONSTRUCTING SEWERS TO SERVE THE SIMONSDALEAREA WHICH WAS ANNEXED ON JANUARY t, 1960"
<br />
<br /> 63-168 - "L submit the attached Ordinance and recommend it be placed on first reading.
<br /> This appropriates $Y5,000.00 in the General Capital Improvement Fund for the purpose of transferring
<br />same to the Annexation BondFund account.
<br /> This is necessary as t~ere are no funds availsbIe t~the AnnexstTon Bond Fund a~count. Bonds were
<br />sold in May 19S3 under the Capital Improvement Fund for the completion of Simonsdale sewers.?
<br />
<br />On motion of Mr. Dillon the following ordinance was approved on first reading:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $75,000.00 FRO~ THE GENERAL CAPITAL IMPROVENiENT FUND FOR THE
<br />PURPOSE OF TRANSFERRING SAME TO THE ANNEXATION BOND FUND (SEWERS)"
