February 11, 1964 <br /> <br />At a regular meeting of the City Council, held on February 11, 1964, the~e were present: <br /> <br />R. Irvine Smith, C. S~'~tkinson, Jack P. Barnes, John L. Dillon, George D. Eastes, L. L. Knight, <br />W. T. Leafy, A P. Johnson, Jr., City Manager, sad M. A. Kerb, Jr., Cisy Attorney. <br /> <br />The meeting was opened with prayer by Mr. Eastes. <br /> <br />Minutes of regular meeting held on Jsnuary 28, 1964, were read and approved. <br /> <br />64-20 - Public hearing on charter changes was held. <br /> <br />The following resolution was read: <br /> <br /> "WHEREAS, Sections 15-65.3 and 15-77.74 of the Code of Virginia,-1950, as amended, provide for <br />smendmen5 of city charters upon the holding of a public hearing and request of the City Council ~o the General <br />Assembly; and <br /> WHEREAS, the City Council is of the opinion that an amendment 5o the Charter of the City of <br />Portsmoutk is necessary and desirable ar this time, and has held the public hearing required by law. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth. Virginia, that the City <br />Attorney is hereby directed to prepare, and the City Manager ~o trsnsmit ~o the.General Assembly, ~ogether with <br />certified copies of this resolution, s draft of s bill amending the hereinafter mentioned section of the Charter <br />of the City of Portsmouth so that said amended section-shall read as follows: CHAPTER XII. SECTION 5. Applicants. <br /> (a) An applicant for an entrance examination under civil service, must be s citizen of the <br />United States of America and s voser of the state of Virginia, who can read and write ~he Eng4ish lsngusge, and <br />must have been s resident of said sta~e for at least one year; provided, however, the civil ~ervice commissLon <br />may reduce such residence requirements with respect to any examination to six months if in their opinion such <br />reduction is necessary ~o secure suffici~n~ qualified spp-tic~nts. In bhe discretion of the civil service <br />~ommission~ residence requiremenss may be waived only for technicsl and P~ofessional posi~tions for which <br />qualified spplicants who are residents of the said city cannot be obtained. <br /> (b) An applicmnt for s position of-any kihd un. er civil service must be of an age s. uitable for <br />the position applied for, in ordinary good health, of good moral character and of 5emperase and industrious~ <br />habits; these facts to be ascertained in ~uch manner ss the commission may deem advisable. <br /> (c) Anything herein to the con~ravy notwithstanding, any person who is no~ a voter of Virginia <br />but is otherwise quaiif.ied shall be eligible for appointment hereunder provided he makes application therefor <br />within 90 days of the date of his ~ischsrge from the aramd forces of the United Btaaes of America,-,and further <br />provided he received an Honorable Discharge. Any person appointed under the prov.lsions of this subsection shall <br />comply with all other provisions of ~his chapter and shall become s qualified voter of the city of Portsmouth <br />within t~elve months of the date of his appointment.." <br /> <br /> The following spoke in regard to the proposed charter change: <br /> <br /> J..A2.Whitehead~ Fire Department. <br /> J. ~ White. Ballentine <br /> <br /> On the reques5 of Mr. Whitehead~ Chairman of th~ ~ir~ Committee, the consideration of this <br />matter was postponed until Friday a~ 4:00 P. M., when.a-special meetingof the Council will be held to hear the <br />repor~ of the committee representing both the Fire and Police Departments. <br /> <br />64-21 ~ Public hearing on petitions for zoning changes was held. <br /> <br />Z 64-2 - Petition of Robert F. Babb <br /> <br /> Mr. J, S. Livesay, Jr., spoke, requesting that the application be referred back ~o the Planning <br />Commission with the recommendation ~hat it be r~oned 5o C-1 rather than <br /> <br /> Motion of Mr. Barnes to refer back to the Pla-nning Commission ss requested was adopted, without <br />dissenting vote. <br /> <br />Z 64-3 - Petitio~ of James N. Psimss, M. D <br /> <br />No one spoke in regard 5o the petition. <br /> <br /> Motion of ~r. Barnes 5o concur in the recommendation of ~he Planning~Commission re disapprove <br />was adopted, without dissenting rose. <br /> <br /> Z 64-4 - Petition of ~alter W.~and Betty R. Philbrick. <br /> <br /> In this connection, the followimg letter from Willism H. Oast, Jr. was read: <br /> <br /> "Please be advised I represent Mr. and ~rs. Walter Philbriek who have an application filed for <br />rezonlng the ~fhea~t Corner of Portsmouth Boulevsrd and City Park Avenue, which is on the City Council agenda <br />for Febru~ary 11, 1964. <br />My clients have requested me to withdraw~this Petition. Therefore, on behalf of Mr. and Mrs. <br />Philbrick, permission is respectfully requested to withdraw this application for rezoning of the said property." <br /> <br /> Motion of Mr. Knight re concur in the reques~ to withdraw the application was adopted, without <br />dissenting rose. <br /> <br />Z 64-5 - Petition of Leonard L.
