September 8th, 1964 <br /> <br />At a regular meeting of the City Council, held on September 8th, 1964, there were present: <br /> <br />R. Irvine Smith, Jack P. Barnes,. John L. Dillon. George D. Eastes, L. L. Knight, W. T. Leafy, <br />A. P. Johnson, Jr., City Manager, M. A Kerb, Jr., City Attorney. <br /> <br />The meeting was opened with prayer by Mr.. Knight. <br /> <br />64-223 The follow±ng public hearing .oR Lrse Permit 64-1 was hetd¥ <br /> <br />No one spoke in regard 5o the permit. <br />The following letter from the City Manager, and enclosures were read: <br /> <br /> "In accordance with See/ion 4-2 of the Zoning Ordinance, I submit herewith a report of the <br />Director of Public Health, Director of Public Works and the Chief of the Fire Department concerning a Use Permit <br />for a cemetery on land adjoining Olive Branch Cemetery." <br /> <br /> "This is in reference to ~the application made b~ the City of Pertsmouth for a "Us~ Permit" for the <br />tract of land bounded by the Olive Branch Cemetery, Clifford Street, Bath's Creek, City Park and the Friendship <br />Gardens for the expansion of the Olive Branch Cemetery. <br /> So far as the Department of Public Works is concerned I can see no reason wily it should not be <br />approved as requested. The property was originslly purchased by the City for this purpose and since the purchase <br />it has been planned by the City Government to ex~end the Cemetery over to Bsin's Creek when needed. <br /> In my opinion the proposed use would not adversely effect the health of. safety of persons residing <br />or working in the neighborhood, nor would Lt be detr,~ental to the welfare ~or'injurious 5G the property or <br />improvements in the general area. F. J. Bergeron, Director of Public Works." <br /> <br /> "In reply to. your request for a report on a use permit fo~ extension of Olive Branch Cemetery, this <br />property was viewed by me. <br /> In my opinion, the extension of the boundaries of the cemetery, as described in your letter, will <br />no~ adversel~ a,ffect the health or-safety of persons residing in the neighborhood, and~ will no.t be detrimental ~o <br />the welfare or injurious to the property and improvements in the neighborhood. Dr. S. A Graham, Director of <br />Public Health." <br /> <br /> "I hav~ investigated the request of the City of Portsmouth for a use permit for the tract of land <br />bounded by the Olive Branch Cemetery, Clifford Street, Bath's Creek, Portsmouth City Pa~k and the Friendship <br />Gardens. <br /> I see no reason why the granting of this reques5 would adversely affect the health or safety of <br />persons residing or working in the.neighborhood or be detrimental to the welfare or injurious 5o the proper~y and <br />improvemenss in the neighborhood. Chief K. L. Host, Chief Bureau of Fire Prevention." <br /> <br /> On the motion of Mr. Barnes, the following resolution was adopted without dissenting vote: <br /> <br /> "EEREAS, the City of Portsmouth has filed an application pursuant 5o Section 4-2 of the Zoning <br />Ordinance of the City df Portsmouth, 1961, for the granting of a use permit as hereinafter described; and <br /> WHEREAS, the applicant, the Planning Director and the City Manager have done all things required to <br />be done in connection with said application, and the Planning Commission has recommended the granting of said use <br />permit. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:. <br /> <br />A. That the use for which the b~se permit, hereinafter described ~s soug~ht (1)will not adversely <br /> affect the health or safety o£ persons residing or working zn the neighborhood of the proposed <br /> use~ (2) will not be detrimental to the public welfare or inj'urious to proper5y or improvements <br /> in the~neighbo~heed, and (3) will be zn accord with purposes of said.~Zo~ing Ordinance. <br /> <br />That the City of Portsmouth is hereby granted a use permit pursuan5 5o Section 4-2 of said <br />Zonisg Ordinance, ~ the constr, uction.and operation ora cemetery ~tG be located on that certain <br />parcel of lan~ ~escribed as fell~ws:~ ~ <br /> : Beginning at the intersection.of the e~st ~ine 'o~ Spruce Head with the north line of <br />Clifford Strees, as shown on the plat of the herein described property on fil~ in the <br />Department of- Pub~i~ Works, Mu~iei~a~ Building, ~ortsmouth, Virginia; thence along said east <br />line of Spruce Road North 13 degrees 3~ minutes East 1038.96 feet to a p~int; thence No~th 69 <br />degr.ees 27 minutes East 389 feet, more or less, to the western boundary of.Bath's Creek; thence <br />in a southerly d~rection alo~g the west~rn'boundnry of Bath's Creek to a point on the north line <br />Df Clifford. Street, as shown on the ~lat~sferesaid; thence along ihe north line of Clifford <br />Street south 41. degrees 23 minutes ~I seconds West 177.75 feet, more or less, to a poinf; <br />thence So~th 43 degrees, 49 minu~es 30 seconds West 272.94 feet to a point; thence~stong a-curve <br />to the right wi£h a radius of 1115.92 feet 147~.74 feet to a point; thence South 50 degrees 58 <br />minutes 55 seconds West 97.70 feet 5o a point; thence along s curve to the right with a radius <br />of 1120.92 feet 255.10 feet then point; thence South 69 degrees 27 minutes West 28.20 feet to <br />the point of beginning. <br /> <br />6~-224 <br /> <br /> Adopted bytthe City Council." <br /> <br /> The following reports from the City Manager were read: <br /> <br />- "I submit the attached resolution and recommend its adoption. <br /> ~This is s resolu~iqn o~nppreciation to Mr..
