<br />On motion of ~4r. Dillon the ordinance was adopted and by the following vote:

<br />65-2 - The following ordinance approved on first reading at last meeting was taken up and read:

<br />THERETO A NEW SECTION NUMBERED 15-17.15 EXEMPTING ANTIQUE VEHICLES AND THEIR PARTS
<br />FROM OPERATION OF THE ABANDONED VEHICLES ORDINANCE, PROVIDED CERTAIN CONDITIONS ARE

<br />65-S - The following ordinance, approved on first reading at last meeting, was taken up and ~ead:

<br />NE~ SECTION NUMBERED 2-22.1, REGULATING THE USE OF TAPE RECORDERS AT MEETINGS OF THE COUNCIL"

<br />In this connection the following letter from George R. ~alker was read:
<br />
<br /> "The Times opposes the passage of the proposed ordinance to ban the use of tape and wire recorders
<br /> by those citizens who atten-~-the public meetings of Portsmouth's city government.
<br /> It is the belief of the Times that the proposed law, as written, is inequitable, an infringement
<br /> upon the right of the citizens of Portsmouth to a full and unabridged record of the Council's official public business
<br /> and an infringement of the right of the Times to the freedom of the press as guaranteed by the First Amendment o{
<br /> the Constitution of the United States.
<br />I It is the intent of the Times to test the constitutionality of the proposed law at the lariiest
<br />.time, and in a manner which will clearly de--re the law being tested.
<br /> To this end it is necessary to request Council to remove the SO day delay between the passage of
<br />'the ordinance and its effective date by amending the proposed ordinance to include an emergency clause making the
<br />~ordinance effective at the time of its passage Tuesday, January 26, 1965.
<br /> Secondly, the Council is requested to hold in abeyance any other real or assumed power it may
<br /> have to hinderror prevent the Times from re~ording only the itemm of council business which pertain te..the consider-
<br /> ation of the proposed banning~pe recording, and the item of business following next on the agenda.
<br /> It is believed that; if Council has faith in the justice and constitutionality of the prop?sed law;
<br /> it will be willing to allow a verbatim record to be made as evidence of its action on the final reading of the law.
<br /> In the same premises it is hoped that Council will not qualify and comoromise the test of the law by invoking other
<br /> unchallenged powers, and allow the test of the law to proceed by the tape recording of the next following item of
<br /> buiness on the agenda."

<br />On motion of Mr. Barnes the ordinance was adopted and by the following vote:

<br />PURPOSE OF PURCHASING A PORTION OF THE LAND REO~IRED FOR THE SITE OF THE NEW JAIL"
