April 13, 1965 <br /> <br />At the regular meeting of the City Council held on April 13, 1965, there were <br /> <br />present: <br /> <br />Jack P. Bar~es, George D. Eastes, L. L. Knight, Burrell R. Johnson, W. T. Leafy, <br />A. P. Johnson, Jr., City Manager, and ~. M. A. Korb, Jr., City Attorney <br /> <br />The meeting was opened with prayer by Mr. Johnson. <br /> <br />65-79 - The following hearing on amendment to the Zoning Ordinance was held: <br /> <br />"AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF PORTSMOUTH, 1961, <br />BY AMENDING SUBSECTION (24) OF SECTION 4-3 THEREOF SO AS TO PROVIDE FOR <br />ISSUANCE OF USE PE~4ITS FOR OPERATION OF AUTOMOTIVE SERVICE STATIONS WITHIN <br />THE WATERFRONT W-1 ZONING DISTRICT" <br /> <br />The City Manager made the following statement.: <br /> <br /> "Due to the inability to properly advertise for Planning Commission hearing on <br />zoning amendment, it is recommended that the Council hearing be deferred until it is properly heard by the Planning <br />Commission." <br /> <br /> Motion of Mr. Knight that the ordinance be referred to the Planning Commission <br />was adopted without dissenting vote. <br /> <br />65-80 - The following hearing on zoning petitions was held: <br /> <br />Petition Z-65-5 - Agent Jefferson Brown on behalf of William Burns and others. <br /> <br />The following spoke for the petition: <br /> <br />Jefferson Brown <br />William Burns <br />J. D. Moore <br />Fred Lipford <br /> <br /> Motion of Mr. Johnson that consideration of the petition be postponed until the <br />report on the study of zoning classifications on Turnpike Road had been received from the Planning Commissi6n, was <br />adopted without dissenting vote. <br /> <br />Petition Z-65-5 - Agent Jefferson Brown <br /> <br />The following spoke for the petition: <br /> <br />Jefferson Brown <br />Mrs. JOhn Collins of 6105 Portsmouth Boulevard <br /> <br /> Motion of Mr. Johnson to concur in the recommendation of the Planning Commission <br />to disapprove the application was adopted, Mr. Leafy voting 'No'. <br /> <br />Petition Z-65-6 - Portsmouth City Planning Commission. <br /> <br /> Motion of Mr. Knight to concur in the recommendation of the Planning Conmission <br />and to place the following ordinance on first reading was adopted without dissenting vote: <br /> <br />"ZONING 7hV~NDMENT ORDINANCE Z-65-6" <br /> <br />Petition Z-65-8 - Agent Herbert G. Gray <br /> <br /> At the request of Donald Kilgore, attorney, deferred to next regular meeting of <br />the City Council on April 27, 1965. <br /> <br />The following communications from the City Manager were read: <br /> <br /> 65-81 - "I submit the attached ordinances and recommend that they be placed on <br />first reading. These establish a two per cent sales and use tax with a four dollar limit in the City of Portsmouth. <br />The tax will be effective June 1~ 1965. <br /> This tax will require the adoption of two ordinances. The first one authorizes <br />the levying of the retail sales tax and the second ordinance establishes rules and regulations for the administratio~ <br />and enforcement." <br /> <br />Motion of Mr. Knight to suspend the rules fo~hear interested persons was adopted. <br /> <br />The following spoke: <br /> <br />A. M. Clement, assistant treasurer, VEPCO, Richmond <br />Lyle Reed, President, Retail Merchants Association <br /> <br /> On motion of Mr. Eastes, the following ordinance was approved on first reading; <br />with the understanding that consideration will be given to the information presented before the second reading of the <br />ordinance; <br /> <br /> <br />
