<br />98-77 Public hearing on a use permit application:
<br />
<br />(a) UP-98-02 CAVALIER MANOR NEIGHBORHOOD - P & N Distributors, Inc.
<br /> requests a use permit to retail gasoline at 4001 Greenwood Drive.
<br /> (Deferred from the April 14, 1998 Council meeting).
<br />
<br />1. Serjay Gorlow, 4001 Greenwood Drive, applicant, provided information on
<br /> the use permit.
<br />2. Lee King, 1504 Belafonte Avenue, spoke in opposition to use permit.
<br />3. Carol Pugh, 1111 Roosevelt Boulevard, spoke in opposition to use permit.
<br />4. Carlton Carrington, 3 Jamal Court, spoke in opposition to use permit.
<br />
<br /> Motion by Mr. Clemons, and seconded by Mr. Griffin, to deny the request
<br />of P & N Distributors, inc. to retail gasoline at 4001 Greenwood Drive, and
<br />was adopted by the following vote:
<br />
<br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley
<br />Nays: None

<br />98-77 Group housing permit:
<br />
<br /> Motion by Mr. Martin, and seconded by Mr. Pitts, to adopt the following
<br />resolution, approved on first reading at the April 14, 1998 Public Hearing
<br />meeting, and was adopted by the following vote:

<br />98-77 (b):
<br />
<br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE
<br />PERMIT (GHP-98-01) TO PERMIT FOUR RESIDENTIAL APARTMENT UNITS AT
<br />630 HIGH STREET.
<br />
<br /> WHEREAS, the applicant, Norman T. Malbon, owner of the subject
<br />property, has made application pursuant to,Section 40-1 t2 of the Code of the
<br />City of Portsmouth, Virginia (1988), as amended, for the approval and granting
<br />of a group housing permit for four residential apartment units at 630 High
<br />Street, Portsmouth, Virginia, more particularly described as follows:

<br /> Beginning at the northeast corner of High Street and Green Street,
<br />thence in an easterly direction approximately 88 feet to the point of beginning;
<br />thence in an easterly direction 25 feet to a point; thence in a northerly direction
<br />approximately 153 feet to a point; thence in a westerly direction 25 feet to a
<br />point; thence in a southerly direction approximately 153 feet to the point of
<br />beginning.
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and
<br />site plan submitted therewith and has recommended conditional approval of
<br />said application; and
<br />
<br /> WHEREAS, the applicant has been informed that approval of the group
<br />housing project pursuant to Section 40-116 only grants an exemption from
<br />certain requirements for residences as stated in said section and does not
<br />constitute a waiver of any other requirement embodied in the Subdivision
<br />Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any
<br />other applicable local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the applicant is aware that building permits or any Other
<br />required permit will be issued only upon compliance with the ordinances, laws
<br />or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
