ADri 28. 1 98 <br /> <br /> BE IT RESOLVED BY the Council:'of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to execute an easement for the <br />provision of electric power to a raw waterPump ~tation of the City of Portsmouth <br />by Virginia Power over under arid ac~'0~ property of the City of Portsmouth <br />which lies adjacent to Pitchkettle Road in thee City. of Suffolk, Virgima, and to enter <br />into such other deeds and agreements' as' may~'be necessary for completion of <br />construction of said pump statiom~'~ ~ ~ ~'' <br /> <br />Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley <br />Nays: None <br /> <br />98-106Adoption of a resolution authorizing the City Attorney to proceed to <br /> condemnation, if the owners of the properties located at 167 Linden <br /> Avenue and 17 Webster Street, andthe City are unable to agree on a price <br /> for the portion necessary to const~dction Of Harrell Street. <br /> <br />Recommendation: ' · <br /> <br />Adoption of a resolution authoriZing the rCity Attorney to proceed to <br />condemnation if the owners of the properties located at 167 Linden Avenue and 17 <br />Webster Street and the City are unable to agree on a price for the portion <br />[~ecessary for construction of Harrell Street. -. <br /> <br />purpose and Need: <br /> <br />Harrell Street is to be constructed pursuant to the City's Vision 2005 Plan. <br /> <br />Financial Imoact: <br /> <br />The property being taken will become public property and non-taxable. <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Pitts, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE .FOR THE ACQUISITION OF CERTAIN <br />PROPERTY OWNED BY B AND K ASSOCIATES, ALSO KNOWN AS B & K <br />ASSOCIATES, A VIRGINIA GENERAL PARTNERSHIP AND BISSETT REALTY, INC. <br />A VIRGINIA CORPORATION UNDER EMINENT DOMAIN PROCEEDING PURSUANT <br />TO THE CHARTER OF THE CITY OF PORTSMOUTH, SAID PROPERTY BEING <br />NECESSARY FOR RIGHT OF WAY TO BE:KNOWN AS HARRELL STREET. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has determined it to be in <br />the public interest to acquire and construct a right of way to known as Harrell <br />Street in the Parkview area of the City; and <br /> <br /> WHEREAS, the City and the Owners have not yet been able to agree upon a <br />purchase price to be paid for property necessary to the project; and <br /> <br /> WHEREAS, the advancement of the work and the use of said property will <br />be unreasonably delayed if said property is not made available for the project as <br />soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />That the City Attorney be, and he hereby is, directed to institute eminent domain <br />proceedings against the hereinafter-described property situate in the City of <br />Portsmouth, Virginia, for the purpose of acquiring fee simple title thereto pursuant <br />to Section 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as <br />amended, and to deposit with the Clerk of the Circuit Court of the City of <br />Portsmouth as provided by law a certificate that the City of Portsmouth will pay <br />the sum designated hereinafter as ordered by the Court to compensate the <br />owners of the property designated and shown as "Exhibit Showing Property To Be <br />Condemned For Harrell Street Extension Owned By B and K AsSociates and <br /> <br /> <br />
