2¸0 <br /> <br />June 22nd, 1965 <br /> <br />the sale of beer and wine on Sundays <br />between the hours of 6:00 A. M. and <br />Midnight? <br /> <br />2. That the form of the proposed ordinance shall be as follows: <br /> <br />AN ORDINANCE TO ;J~END SECTION 19-10 OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1961, TO ALLOW THH SALE OF BEER AND WINE ON <br />SUNDAYS BE~qEHN THE HOURS OF 6:00 A. M. AND <br />12:00 MIDNIGHT. <br /> <br /> Be it ordained by the electors of the <br />City of Portsmouth, Virginia, that Section <br />19-10 of the Code of the City of Portsmouth, <br />VirKinia, 1961, be amended and reordained to <br />read as follows: <br /> <br />Sec. 19-10. Same--~en sale of beer and wine prohibited. <br /> <br /> It shall be unlawful for any person to <br /> sell, or for any person holding a license <br /> from the Alcoholic Beverage Control Board of <br /> Virginia to ~ermit to be sold at his place <br /> of business, between the hours of 12:00 Midnight <br />- :~cof 8ach Saturday and 6:00 A.M. of each Sunday, <br /> any beer or wine as defined by the Alcoholic Beverage <br /> Control Act. This section Shall not affect the sale <br /> of beer and wine on passenger trains or steam vessels <br /> while operating in interstate commerce. <br /> <br /> Any person who shall violate the provisions of <br />this section shall be punished by a fine of not less <br />than ten dollars nor more than one hundred dollars, <br />or by confinement-~in jail not exceeding one month, <br />either or both. <br /> <br /> 3. That the Electoral Board of the City be, and they are hereby directed <br />to make the necessary arrangements for the election and take the sense of the qualified voters of the <br />City on the question as hereinabove set forth. <br /> 4. That the prononents of the said ordinance shall nresent to the City Clerk <br />on or before August 6, 1965, 20,000 conies o~ their ~rinted argument in favor of such ordinance, such <br />argument to be nrinted on green colored naper and folded so as not to exceed 8~1/2 inches by 3 3/4 inches. <br /> S. That the opponents of the said ordinance shall present to the City Clerk <br />on or before August 6, 196S, 20,000 co~ies of their printed argument against the s~id ordinance, such <br />argument to be printed on yellow colored paper and folded so as not to exceed 8 1/2 inches by 3 5/4 inches. <br /> <br /> 6. That such printed matter shall be identified with the names of the <br />persons or groups submitting the same. <br /> 7. That only one ~rinted argument in the prescribed quantity will be accepted <br />from the proponents and the opponents, respectively. <br /> 8. That neither of such arguments shall exceed 2,000 words. <br /> 9. That the City Clerk is directed to transmit forthwith to the Electoral <br />Board of the City a certified copy of this resolution. <br /> <br />held June 22, 1965." <br /> <br />Adopted by the Council of the City of Portsmouth, Virginia, at a meeting <br /> <br /> Motion of Mr. Johnson to change the word "red" in paragraph #S to "yellow" was <br />adopted, without dissentin~ vote. <br /> <br /> On motion of Mr. Johnson, the petition was adopted, and by the following vote: <br /> <br /> Ayes: Smith, Barnes, Dillom, Hastes, Johnson, Knight, Leary <br /> Nays: None <br /> <br /> NEW BUSINESS <br /> <br /> 65-163 - The followinM communication From Portsmouth Coast Guard Museum, Inc.. was <br />read: <br /> "The Board of Directors of the Portsmouth Coast Guard Museum, Inc., has made <br />a careful study and consideration of the land area needed for the ¢roper development of a;tightship museum <br />and other suitable facilities necessary for the success of this undertaking. The Board has unanimously <br />determined that the following property will be required For the proper development of this museum: <br /> The southern line of the property wo~ld begin at the northern line of the <br />parking area established for the Naval Shipyard Museum and then in a northerly direction extending from <br />the Elizabeth River on the east to Water Street on the west with the northern line of the needed property <br />fifty (SO) feet north of the northern line of London Street, if extended, and to include all property from <br />Water Street to the Elizabeth'Ri~er. .~,,~- ~ <br /> It is the hope of the Board of Directors that provision can be made for this <br />property to be placed at the disposal of th~ Portsmouth Coast Gusrd Museum, Inc., and we will anpreciate favorabl~ <br />action by Council in regard to the above request." * <br /> <br /> <br />
