<br />At a regular meeting of City Council, held on August 24th, 1965, there
<br />
<br />were present:
<br />
<br />R. Irvine Smith, Jack P. Barnes, John L. Dillon, George D. Hastes,
<br />Burrell R, Johnson, L. L. Knight, A. P. Johnson, Jr., City Manager,
<br />and M. A. Korb, Jr., City Attorney.
<br />
<br />The meeting was opened with prayer by ~. Knight.
<br />
<br />Minutes of regular meeting held on August 10th, 1965, were read and approved,
<br />
<br />The following public hearings were held:
<br />
<br /> 65-218 - "An Amendment to the Comprehensive Plan for the City of Portsmouth
<br />which after a public hearing on July 6th, 1965, was recormmended unanimously by the City Planning Commission:
<br />'COMPREHENSIVE PLAN A~NDMENT CP-6S-1, WEAVER REDEVELOPmeNT PROJECT, LAND USE MAP, R.P-2, VA R-40, R-213,
<br />PORTSF~UTH REDEVELOPMENT AND HOUSING AUTHORITY, FEBRUARY, 1965'"

<br />NO one spoke in regard to the proposed amendment.
<br />
<br />Motion of ~. Eastes to approve the Comprehensive Amendment was adopted,
<br />
<br />without dissenting vote.
<br />
<br />65-218 - UP 65-5 - Petition of Attorney Jefferson B. Brown.
<br />
<br />~. Kilgnre and Rev. Clyde Beatty of St. James Episcopal Church spoke.
<br />
<br /> Motion of Mr. Barnes to adopt the following resolution and approve the
<br />Use Permit, was adopted, without dissentin~ vote:
<br />
<br /> "WHEREAS, the Texas Company has filed an application pursuant to Section 4-2
<br />of the Zoning Ordinance of the City of Portsmouth, 1961, for the granting of a use permit as hereinafter
<br />described; and
<br /> ?~HREAS, the applicant, the Planning Director, and the City Manager have
<br />done all things required to be done in connection with said application, and the Planning Commission
<br />has recommended the granting of said use oermit.
<br /> NOW, ~{EP~FORE, BE IT RESOLVED by the Council of the City of Portsmouth,
<br />Virginia:
<br /> 1. /"hat the use for which the use oermit hereinafter described is sought
<br />{a) will not adversely affect the health or safety of persons residing or working in the neighborhood
<br />of the proposed use, (b) will not be detrimental to the mublic welfare or injurious to property or
<br />improvements in the neighborhood, and (c) will be in accord with the purposes of said Zoning Ordinance.
<br /> 2. That the Texas Company is hereby granted a use hermit, pursuant to
<br />Section 4-2 of said Zoning Ordinance, for the construction and oneration of an automotive service station
<br />on the property described as follows:
<br /> Beginning at the southwest corner of Effingham
<br /> Street and South Street; thence west along South
<br /> Street approximately 150 feet; thence south
<br /> approximately 110 feet; thence east approximately
<br /> 50 feet; thence south approximately 70 feet; thence
<br /> eas~ approximately 100 feet to Hffingham Street:
<br /> thence north alon~ Effingham Street approximately
<br /> 180 feet to the ~oint of beginning."

<br />Mr, Kilgore spoke.
<br />
<br /> The following letter from Mrs. Evelyn Garthright Mann and Larose M. Mann
<br />
<br /> "We the undersigned, petition the application of Thomas H. and Clara F.
<br />Harden to re-zone the property at the northeast corner of VicR Street and Jewell Avenue from Residential
<br />R-75 to Commercial C-1. I have been a resident of Simonsdale at 805 JewelI Avenue for nineteen [19)
<br />years which is directly across the street from the property in question. Many types of businesses have
<br />tried to operate in Simonsdale at the above mentioned property and failed. We are sorry that the McLean
<br />property was re-zoned Commercial, we were out of town at that time. These buildings are unsightly to
<br />a residential area and at times operate late into the night making noises which are disturbing to a
<br />resident with children or residents who have to retire early due to their working hours. The Island in
<br />the intersection of the above named streets was beautified many years ago by the Simon~dale Garden Club
<br />of which I was oresident for two years. Mr. Harden uses it for parking and placing his tractors etc. on
<br />it. I am sure that you are aware of the many adjourning areas to Simonsdale which are already zoned
<br />commercial, therefore, these establishments are most convienent to us. There are no personal feelings
<br />involved in this netition as I do not know ~ither Mr. Or Mrs. Harden, but we are most concerned for our
<br />Community. Please let us b~3considered and heard in this matter, and would appreciate you seeing that
<br />each member of the City Council receives a copy of our petition."

<br /> Motion of Mr. Barnes to refer back to the Planning Commission for
<br />resubmission, was adopted, without dissenting vote.

<br /> Motion of Mr. Eastes to aporove the following ordinance on first reading,
