<br /> "THAT WHEREAS, Cavalier b~eadows, a partnership composed of Bide-A-Wee Corporation,
<br />Wimac Cozporation, Plymouth Development Corporation and Dale Fairless Realty Corporation, is the owner
<br />and developer of that certain subdivisionaof land situated in the City of Portsmouth, Virginia, shown
<br />on that certain plat entitled "Cav~er Manor, Section 20B, Portsmouth, Virginia," dated August 7, 1964,
<br />made by Baldwin and Gregg, Civil Engineers and Surveyors, and duly recorded in the Clerk's office of
<br />the Court of Hustings for the City of Portsmouth, Virginia, in Map Book 4, at page 76; and
<br /> WHEREAS, the said Cavalier Meadows, a partnership, has discovered certain engineering.
<br />and survey errors that affect lots 32 through 34, both inclusive, Lots 41 through 45, both inclusive,
<br />Lots 64 through 66, both inclusive and Lot S8 as shown on said plat; and
<br /> ~tEREAS, it is the desire of the said C~valier Meadows, a partnership as owner of the
<br />lots aforementioned affected by the error on the recorded plat to vacate that portion of the ~lat subject
<br />to said error pursuant to paragraph {a) of Section 1S.1 - 482 of the Code of Virginia of 1950 and
<br />amendments th~meto; and
<br /> WHEREAS, the aforementioned code section requires the owners of the lots on the said
<br />plat by written instrument to agree to said vacation and to secure the approval of the governing body of
<br />the municipality wherein the property lies,
<br /> NOS,I, THEREFORE, BE IT RESOLVED: ~at the City Manager of the City of Portsmouth, Virginia
<br />on behalf of the City Council of the City of Portsmouth, Virginia, as its governing body, is hereby
<br />authorized to execute an instrument vacating that portion of the said plat lying to the West of the Eastern
<br />boundary line of Lot S8 as shown on said recorded plat indicating thereby the approval of the City Council
<br />of the City of Portsmouth, Virginia, to said vacation, but before executing said written instrument,
<br />the City 5h~nager shall secure the approval of the City Attorney as to ~he form of said instrument."

<br /> "Following a public hearing at its regular monthly meeting on September 7, 1965,
<br />the City Planning Commission acted upon tko following three rezoning p~titions:

<br /> Z-65-2~ Petition of Rufus A. Powell to rezone property described as follows:
<br />Beginning at a point approximately 220' eastoof the northeast corner of Elm Avenue and County Street; thence
<br />north along a lot line approximately 115'; thence east approximately 25'; thence south to the north ~ight-of-
<br />way line of County Street approximately 115'; thence west along said right-of-way line approximately 25'
<br />to the point of origin; from Residential R-60 to Con~nercial C-2. ~ne Commission resolved to recommend
<br />approval in keeping ~th other similar changes approved earlier in this ~rea.

<br /> Z-65-24 Application of the City Planning Commission on behalf of petitioning
<br />citizens and at the request o~Cou~cil to rezone property described as follows: Beginning at the
<br />centerline of Greenwood Drive approximately 220' west of the centerline of George ~ash~ngton Highway;
<br />thence north approximately 275' along the eastern property line of 2012 Greenwood Drive: thence west along
<br />a rear lot line approximately SO0' to the west side property line of 2112 Greenwood Drive; thence south
<br />approximately 430' to the centerline of Barclay Avenue; thence east along Barclay Avenue approximately
<br />230' to the centertine of Greenwood Drive; thence east approximately 200' to the point of origin; from
<br />Commercial C-2 to Residential R-7S.
