3'70 May 26, 1998 Motion by Mr. Martin, and secondedb~/Mr. Pi~'i to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO AMEND CHAPTERS 16, 23, AND 35~OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 16-69(b), 23-7, 35-3(e), 35-5(a), AND 35-74 AND BY REPEALING SECTIONS 35-31 THROUGH 35-39 THEREOF PERTAINING TO THE POSITION OF DELINQUENT TAX COLLECTOR." ' Ayes: Benn, Clemons, Griffin, Martin, Pitts, Robinett, Holley Nays: None 98-128 Adoption of a resolution to approve amendment of the Charter of the Hampton Roads Planning District Commission (HRPDC) to allow any commissioner to serve as Chairman or Vice Chairman, provided he or s he is an elected official. The Charter amendment also provides that the Vice-Chairman would serve as Chairman- elect. Recommendation_: Adoption of a resolution approving amendment of the Charter of the Hampton Roads Planning District Commission to allow any Commissioner to serve as Chairman or Vice Chairman, provided he or she is an elected official. The Charter amendment also provides that the Vice.Chairman would serve as Chairman-elect. . Pur:. ose and Need: The Hampton Roads Planning District Commission is composed of Several representatives from each of the fifteen member jurisdictions. The number of commissioners from each jurisdiction is based on population, but only one member from each locality is on the Executive Committee. Currently, the Chairman and Vice Chairman of the HRPDC must be elected officials who also serve on the Executive Committee. Since many communities appoint the City Manager or County Administrator to the Executive Committee, the pool of candidates from which to draw nominees for Chairman and Vice Chairman is small. The HRPDC still desires that its officers should be elected officials, so this Charter change would permit any elected official, whether or not a member of the Executive Committee, to serve as an officer. Voting on the Executive Committee is on the basis of one member and one vote for each member jurisdiction. If the Chairman or Vice Chairman is not from the Executive Committee, they would become ex- officio members of the Executive Committee. To preserve the one vote limitation for each jurisdiction, the officer and the other voting member from each jurisdiction would each receive one-half vote. · This amendment would become effective upon app~roval of two-thirds of the fifteen member jurisdictions.
