<br /> To our knowledge March 12, 1967 is the first time the public was made aware of any p~oposed
<br />change in subject ordinance, in view of this it is respectfully requested that a representative
<br />of this league be permitted to make a few remarks to the Council at the regular City Council meeting
<br />of March 14, 1967."

<br /> On motion of Mr. Barnes, rules were suspended to hemr Mr. Keller, ~o spoke, asRing that action
<br />on the ordinance be deferred until an item is presented in the press, by the City Manager, explaining
<br />the expenditures involved.
<br />
<br /> Motion of Mr. Smith to table action on the following ordinance until Mr. Keller's request is
<br />granted, was adopted, and by the following vote:
<br /> Ayes: Smith, Johnson, King, Lea~z

<br />ADDING S~4ITARY SEWERS TO THE LIST OF REQUIRED CAPITAL IMPROV£~NTS SET FORTH~HERBtN"

<br /> 67-60 - "I submit the attached resolution and recommend its adoptidn. This approves a five-Fear
<br />Capital Improvement Program for the proposed anneKation area.
<br /> This approves the ex?enditure of $5,579,854 ~dr a new school buildings, sewers~
<br />storm drainage, and street and bridge construction. The street and bridge construction is contingent
<br />upon the State Highway Department's participation under the current law of 85% State and 15% local
<br />funds.
<br /> This ~lso approves the expenditure of $902,576 for the purchase of additional equipment
<br />to serve the annexed area."
<br /> On motion of Mr. King, the following resolution was adopted, without dissenting vote:
<br /> "WHEREAS, the Council o~ the City of Portsmouth, Virginia, adopted an ordinance December 9, 1961,
<br />to petition the Circuit Court of Norfolk County, VirgSnia, for the annexation of certain territories
<br />lying in Norfolk County, now the City of Chesapeake; and
<br /> ~HEREAS, said ordinance provided generally for the provisions planned for the future development
<br />of the terriiories proposed to be annexed; including the provision of public utilities and services
<br />therein; and
<br /> WHEREAS, the City Manager has prepared an exhibit to be filed with the Court in said annexation
<br />proceeding setting forth the details of estimated~costs, projects and programs based upon existing
<br />conditions, to carry out the so-called five year capital improvement progr~ for the territories sought
<br />to be annexed.
<br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Portsmouth ratifies and approves
<br />the Fiye Year Capital Improvement Program for the Annexation Area, in the principal amount of $5,379,854.00
<br />and the purchase of additional equipment to serve said area in the principal amount of $902,376.00 as
<br />detailed upon an exhibit presented by the City Manager, which said exhibit is to be filed in the
<br />annexation proceedings and a copy of which is to be filed with the minutes of this meeting. Capital
<br />improvements for streets and highways as depicted in said exhi§it are contingent upon said projects being
<br />financed not to exceed fifteen per cent by the City of Portsmouth through Federal ~nd State programs."
<br />
<br /> 67-61 - "I s~omit the attached resolution and recommend its adootion. This authorizes the signing
<br />of a contract for a grant Under the Open Space Program,
<br /> It is necessary to sign this contract in order that we can receive our Federal
<br />fUnds ~o cover the purchase of the 0bici property."
<br />
<br /> On motion of Mr, Bastes, the following resolution ~as adopted, without dissenting, vote:
<br /> "WHEREAS, the City of Portsmouth (the "Appi~icant"), has heretofore submitted an application
<br />to the United States of America, Department of Housing and Urban Develooment (the "Government"), for
<br />a grant under Title VII of the Housing Act of 1961, as amended, with respect to a certain project
<br />identified as Project No. VA 0SA-25, for the purpose designated in the said application; and
<br /> WHEREAS, the Government has approved the said application s~bject to certain conditions
<br />and has submitted to the Applicant a certain Contract for Grant identified as Contract No. VA OSA-25(G)
<br />(the "Contract")~ ~ar approval and execution by the Applicant, which said contract is ~atisfactory,
<br /> NOW/?THEREFORE, BE-IT RESOLVED BY THE Council of the Applicant, that the said Contract, a copy
<br />of which is attached hereto, be and the same is hereby approved. The City Manager is hereby authorized
<br />and directed to execute the said Contract in the name and on behalf of the Applicant, in as many
<br />counterparts as maybe necessary, and the City Clerk is hereby authorized and directed to affix or
<br />impress the official seal of the Applicant thereon and to attest the same. The orooer officer is directed
<br />to fegw~rrd the said executed counterparts of the said Contract to be Government, together with such
<br />other documents evidencing the approval and authorization to execute the same as may be required by the
<br />Government."

<br />-UNFINISHED BUSINESS-
<br />
<br /> 67-46 - The following communication from the Director of Planning was read:
<br /> "A~ ils regular monthly meeting on March 7, 1967, the City Planning Commission at your
<br />request again reviewed the matter of commercial rezoning on the southwest corner of Deep Creek
<br />Boulevard and Elliott Avenue.
<br /> At this open public meeting, the Planning Commission was advised of petitions received
<br />by City Council favoring approval of rezoning petition Z-67-3 and was presented the very handsome
<br />model submitted at your public hearing in connection with the proposal.
<br /> However, the Planning Com=mission resolved to stand by its earlier position and recommend
<br />denial of this application for ~easons stated.
<br /> The Commission ex?teases appreciation for your interest in its opiniQn and for your concern
<br />over proper public presentation of all relevant facts."

<br /> Motion of Mr. Knight to concur in the recommendation of the Planning Commission to disapprove the
<br />application, was adopted, without dissenting vote.
