<br /> This appoints viewers for the closing of a portion of Hanover Avenue and a portion
<br />of Lancaster Street. This closes Hanover Avenue between the northern right-of-way line of South
<br />Street and the southern right-of-way line of the Seaboard Eeasttine R~ilroad, and Lancaster Street
<br />between the northern right-of-way line of South Street and the southern riTght-of-way line of Columbia
<br />Street.
<br /> This closing has been requested ~y the Earl Drum Realty Corporation and has been approved
<br />by the Planning Commission."

<br />an motion of Mr. King, the following resolution was adopted, without dissenting vote:

<br /> "WHEREAS, Earl Drum Realty Corporation has made application to vacate and close that mortion
<br />of Hanover Avenue lying between the northern right of way line of South Street and the southern right 6f
<br />way line of the Seaboard Coast Line Railroad and that portion of Lancaster Avenue lying between the
<br />northern right of way line of South Street and the southern right of way line of Columbia Street, and
<br />it appearing that notice of the Knplication and request for the appointment of viewers was .duly
<br />posted on August 25, 1967, on the bulletin board of the Court of Hustings for the City of Portsmouth,
<br />on the bulletin board of the Circuit Court of the City of Portsmouth, and on the bulletin board of
<br />the Municinal Court of the City of Portsmouth.
<br /> NOI~, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that R. A.
<br /> Craig, Jr,, Frank N. Bilisoly, Louis Leitner, ~illard C. Norman and Leo V. Schocklin be appointed
<br /> viewers to view said streets and renort to this council in writing whether in their opinion any,
<br /> and if any, what inconvenience would result from vacating and closing the aforementioned parts of Hanover
<br /> Avenue and Lancaster Avenue." -

<br /> 67-261 - "I submit the attached resolution and recommend its adoption.
<br /> This-establishe~ policy for the City of Portsmouth for the acquisition of land and
<br />relocation of persons in connection with the City's application to the Department of Housing and
<br />Urban Development for Mater Facility improvements.
<br /> tie have previously submitted this application requesting a grant in the amount
<br />of $1,257,S00.00 which was approved by the City Council but we failed to adopt::~fihis resolution as
<br />required, l~hile this resolution is required we do not anticipate the acquisition of any land that
<br />would require the relocation of any families."

<br /> On motion of Mr. Eastes, the resolution was unanimously adopted.

<br /> 67-262 - "I recommend that the lease between the Virginia State Ports Authority and the City
<br />of Portsmouth, for the Pinners Pbint Marine Terminal, be assigned to the Portsmouth Port and
<br />Industrial Commission.
<br /> This is requested as the Portsmouth Port and Industrial Commission will be
<br />responsible for the operation of the Marine Terminal.'~

<br /> Motion of ~r. King to concur in the recommendation of the City Manager was adopted, without
<br />dissenting vote.
<br />
<br /> 67-265 - "I recommend that the proper City official be authorized to sign an agreement~:betwe~n
<br />the Norfolk and ~estern Railroad Company and the City of Portsmouth.
<br /> This covers the installation of an 8" water line crossing under the railroad company's
<br />tracks, just west of Gust Lane in Portsmouth."
<br />
<br /> Motionc-of Mr. Knight that the proper city official be authorized to sig~ the agreement
<br />was adopted, without dissenting vote.
<br />
<br /> 67-264 - "Attached, hereto, is a letter received from Mr. H. M. Jones, President of
<br />the Tyree-Jones Motor Corporation; addressed to the Mayor and the City Council and was
<br />referred to me by the Mayor.
<br /> Mr. Jones is requesting a refund of his business license as he has closed his
<br />business onnJuly ~.,1967. There is no p~ovis~q~,, in our license tax ordinance, for the proration
<br />of business license nor the refund of the same. We, therefore, cannot comply with Mr. Jones' request."
<br />
<br /> Hotion of Mr. Johnson to receive as information and that the City Manager so advise Mr. Jones,
<br />was adopted, without dissenting vote.
<br />
<br /> 67-265 - "Attached hereto, are two (2) letters from the Honorable Judge John A. MacKenzie
<br />advising ns of his resignation from the Board of Zoning Appeals and the Solicitation Commission, d~ec-
<br />to his appointment as a Judge of the United States District Court, for the eastern d'istrict bf
<br />Virginga. The Board of Zoning Appeals is appointed by the judg~ of Hustings Court and the Solicitation
<br />Commission is appointed by the City Manager. This is for your ~hformation."
<br />
<br /> Motion of Mr. Barnes that the letter be received as information and that the Clerk write
<br />Judge MacKenzie thanking him for his services in both capacities, was adopted, without dissenting
<br />vote.
<br />
<br /> 67-266 - "I recommend that I be authorized to transfer City owned property to the Portsmouth
<br />School Board.
<br /> It is the property on which the Trmxton School is located. This request is being
<br />made in order that the School Board can make adjustments in its property lines with the adjoining property
<br />owners," '
<br />
<br /> Motion of Mr. Eastes to concur in the recommendation of the' City Manager was adopted, without
<br />dissenting vote.
