<br />USE PERMIT 68-1 - Petition of Wayne L. Crawford.
<br />
<br />On motion of Mr. Leafy, the following resolution was adopted, without dissenting vote:
<br />
<br />"WHEREAS, Wayne L. Crawford has filed an application pursuant to Section 4-2 of the Zoning
<br />Ordinance of the City of Portsmouth, 1961, foz the granting of a use permit as hereinafter described;and
<br /> WHEREAS, the applicant, the Planning. Director and the City Manager have done all things required
<br />to be done in connection with said application, and the Planning Conunission has recommended the
<br />granting of said use permit, subject to the conditions hereinafter stated.
<br /> NOW, THEREFOP~, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br /> A. That the use for wkich the use permit hereinafter described is sought (1) will not
<br /> adversely affect the health or safety of persons residing or working in'~he neighborhood
<br /> of the proposed use, (2) will not be detrimental to the public welfare or injurious to
<br /> property or improvements in the neighborhood, and (3) will be in accord with the purposes
<br /> of said Zoning Ordinance.
<br /> B. That the use permit hereinafter granted shall be subject to the following condigions:
<br /> 1. There shall be no Mobil Oii sign erected upon the property other than at the northwest
<br /> corner thereof in the location specified in the site ptRn.
<br /> 2. There shall be no banners, streamers, whirling devices, strings of lights or devices
<br /> of similar nature used upon the property and any lease entered into with respect
<br /> to the property shall contain provisions prohibiting such use.
<br /> S.The facility shall be constructed in such a manner that it will not interfere
<br /> with the Effingham Street improvement program of the City of Portsmouth.
<br /> 4. There shall be no secondary use of the property beyond that specified in the site
<br /> plan and any lease entered into with respect to the property shall contain provisions
<br /> prohibiting such use.
<br /> 5. Seeded areas shall be carefully landscaped so as to create and maintain an attractive
<br /> facility.
<br /> C. That Wayne L. Crawford is hereby granted a use permit, pursuant to Section 4-2 of gaid
<br /> Zoning ordinance, ~or the construction and operation of a gasoline service station to
<br /> be located on the property described as follows: Beginning at the southwest corner of
<br /> Effingham and Scott Streets; thence south approximately 230 feet to the north right of way
<br /> line of Duke Street; thence west approximately 180 feet to the said line to a point;
<br /> thence north approximately 230 feet to the south right of'way line of Scott Street; thence
<br /> east along said line approximately 180 feet to the point of origin."
