February 13, 1968 <br /> <br /> 68-33 - "t recommend that the proper City officials be ~thorized to sign a lease with <br />Darnoc Corporation for rental of space in the Churchland Shopping Center for use as a branch <br />library. This is the same location at which the CitM of Chesapeake had their branch library. The rental <br />fee is $250 per month and it is anticipated ti{at we willlhave to use these facilities for approximately <br />tWO years, <br /> We are now in the process of preparing an application for Federal funds for the <br />construction of a new branch library." <br /> <br /> Motion of Mr. Knight to concur in the recon~endation of the City Manager was adopted, without <br />dissenting vote. <br /> <br /> 68-34 - "In November of 1966, I recommended to the City Council that the Use Permit issued <br />to the American Iron and Metal Company for operation of a junk yard on Belt Line Railroad property, <br />adjacent to Harbor Drive be revoked. <br /> At that time, Mr. Jacobson, owner of k~erican Iron and Metal Company, along with his attorney <br />appeared before the City Council and assured the Council ~at they would take steps to correct <br />the conditions on this property. Mr. Jacobson stipulated by letter that he would: 1. Landscape the entire view on the highway side. <br /> 2. The pile of material that could be viewed from the highway side would be <br /> reduced in size and not be above the height of the fence. <br /> 3. The entire premises to be screened in with a gate located a~ the foot of Lee to <br /> be locked at all times exceot when materials are brought in. <br /> 4. Have an attendant at all times. <br /> $. No inflammable or combusti6nable materials to be stored. <br /> 6. Keep the premises in a clean, attractive and proper manner at all times. <br /> Since November, 1966, absolutely nothing has been done to correct the situation and <br />none of the things stipulated in Mr. Jacobson's letter done. I therefore recommend that this "Use <br />Permit" be revoked." <br /> <br /> On motion of Mr. Hastes, the rules were susnended to hear Mr. David Levine, who asked for <br />thirty days in which to correct the existing conditions. <br /> <br />Motion of Mr. Johnson that the request be granted, was adopted, without dissenting vote. <br /> <br /> 68-55 - "I submit the attached resolution and recommend its adoption. This authorizes condemnation <br />proceedings for the acquisition of property needed for the London-Glasgow Street expressway. <br /> This action is necessary due to title deficiencies and not being able to reach an <br />agreement with the property o~er." <br /> <br />On motion of Mr. King, the following resolution was adopted, without dissenting vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE <br />CITY OF PORTSMOUTH UNDER EMINENT DOMAIN PROCEEDINGS PURSUA~T TO CHAPTER <br />229 OF THE ACTS OF ASSEMBLY OF 1966, SAID PROPERTY BEING NECESSARY FOR THE <br />CONSTRUCTION, WIDENING ~ND IMPROVEMENT OF STATE HIGHWAY ROUTE S8 FROM <br />THE INTERSECTION OF At-RLINH BOULEVARD ~ND HIGH STREET TO THE INTERSECTION <br />OF LONDON ~%ND EFFINGHA~{ STREETS. <br /> <br /> WHEREAS, in cooperation-with the Federal and State governments, State Highway Route 58 is b~ing. <br />constructed, widened and improved from the intersection of Airline Boulevard and High Street to <br />the intersection of London and Effingha~n Streets in the City of Portsmouth, Virginia; and <br /> ]%~{EREAS, one of the obligations of the City of Portsmouth with respect to said project is <br />the provision of the land necessary for the construction; and <br /> ~%~{HREAS, the City of Portsmouth has found it to be necessary to acquire the interest hereinafter <br />specified in and to the hereinafter described parcels of land situate in the City of Portsmouth, <br />Virginia, for the purpose of constructing, widenin~ and improving the aforesaid State Mi'ghway <br />Route 58; and <br /> WHEREAS, the Cit? of Portsmouth has not been able to nurchase the oroperty described herein, <br />necessary to the project, because the o%~alers thereof and the City have not been able to agree <br />upon the price to be paid therefor, or the City has not been able to locate certain of the owners <br />or because of the status of the title of certain parqels~of the property; and <br /> I*~EREAS~ advancement of the work and use of said State Highway Route 58 will be delayed <br />unreasonably'if the said property is not made available as soon as possible. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> Section 1. The City Attorney is directed to institute eminent domain proceedings, employing <br />special counsel for that purpose if he deems it advisable, against the property hereinafter <br />described located along State Highway Route 58, for the purpose of acquiring fee simple title therein, <br />together with a temporary construction easement in accordance with and pursuant to Section 23 [F) of <br />the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly of 1966), and to deposit <br />to the credit of the court as provided by law the s~ hereinafter soecified to comnensate the <br />respective owners of the various ~arcels of land, as shown on those certain olans entitled Project <br />0058-124-102, R/W 201 and 202 dated February 14, ]966, sheet 7, a copy of which is filed with the <br />Department of Public Works of the City of Portsmouth, Virginia: <br /> <br />PARCEL NA~-~ A~UNT <br /> <br />036 Ametia J. The City Attorney is authorized to proceed against each individual oarcet and <br />the respective owners thereof or against such combinations of ~arcels and the respective owners <br />as he shall deem advisable." <br /> <br /> <br />
