The City Attorney is authorized to proceed against each individual oarcel and the <br />respective owners thereof or against such combinations of parcels and the respective owners therof as he <br />shall deem advisable." <br /> <br /> 68-76 = "I submit the attached resolution resolution and recommend its adoption. This authorizes <br />condemnation proceedings for an easement needed for a sanitary sewer. This easement is to be used for <br />the sewer to be constructed to the Londontown Manufacturing Company and other properties in this area. <br />This condemnation is necessary due to title deficiencies. <br /> <br />On motion of Mr. King, the following resolution was adopted, without dissenting vote: <br /> <br />"A RESOLUTION TO PROVIDE FOR ~IE ACQUISITION OF CERTAIN PROPERTY BY THE CITY OF PORTSMOUTH <br />UNDER EMINENT DOMAIN PROCE~plNGS PURSUanT TO CH33TER 229 OF ASSEM5LY OF 1966, SAID PROPERTY <br />BEING~q~BCESSARY FOR THE CONSTRUCTION OF A SANITARY SEWER TO SERVE TNE LONDONTOWN MANUFACTURING <br />COMPANY. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to construct a sani:ary sewer to serve <br />the Londontown Manufacturing Company; and <br /> <br /> EMEREAS, the City of Portsmouth has acquired all necessary property interests necessary for the <br />said sanitary sewer except that which is described herein; and <br /> <br /> E~EREAS, ihe City of Portsmouth has not been able to ourchase the property described herein, <br />because the owners thereof are unable to convey legal titl~ to such property; and <br /> <br /> IqH~REAS, the advancement of the construction and use of the said sanitary sewer will be unreasonably <br />delayed if the said property is not made available as soon as possible. <br /> <br />NOW, THEREFORE, be it resolved by the Council of the City of Portsmouth, Virginia: <br /> <br /> SECTION 1. The City Attorney is directed to institute eminent domain~proceedings, employing <br />counsel for that purpose if he deem it advisable, against the property hereinafter described for the <br />purpose of obtaining a perpetual and exclusive easement therein, in accordance with and pursuant to <br />Section 23 (F) of the Charter of the City of Portsmouth (Chapter 229 of the Acts of Assembly of 1966), <br />and to deposit to the credit of the Court as provided by law the sum hereinafter specified to <br />compensate the respective owners of the property. <br /> <br />DESCRIPTION: <br /> <br /> All that certain lot., piece or parcel of land, fifteen (,15) feet in width, situate, <br />lying and being in the City of Portsmouth, Virginia, and further described as follows: <br />Beginning at the point at which the boundary line between the property now or formerly <br />~gng~n~td~T~Jl~.S%~ea~l~yt~md}?~hpap~e~ty of Cas$ie J. Feimster, et als, intersects <br /> tha northerly line of Claremont Drive, and thence running N. 26: 30' W. 707.0' to a ooint; <br /> thence N. 63~ 30' E 15' to a point; thence S. 26~ 30' E. 707.0', more or less, to a ~oint <br /> in the northerly line of Claremont Drive; thence running along Claremont drive in a westerly <br /> direction 15' to the point of beginning; it being part of the same property conveyed to <br /> Harry B. Feimster and Cassie J. Feimster by deed date June 25, 1955, and recorded in the <br /> Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia~ in Deed Book 1185 <br /> at page 338. <br /> <br /> OWNERS: <br /> <br /> Cassie J. Feimster, Barbara Ann Neal, et ux, Ruby F. Scott, et ux, John E. Feimster <br />and Michael L.
