<br />for the ~ssuance of a building permit on property at the north end of Cypress Road. In 1965, Mr. Warren
<br />submitted his plat to the Building Official's office and the oublic Works Deoartment requesting a building
<br />permit. Mr. Warren was advised it would be necessary to dedicate a SO foot ~ight-of-way, construct a
<br />culdesac, provide a draingate easement and participate in the cost of part of the drainage work; this being
<br />the only basis that a building permit could be issued.

<br /> Point Lane on which the property in question abuts, is 30 feet in width and we can find no evidence
<br />where this lane has been dedicated.
<br />
<br /> The zoning oridiance prohibits the issuance of a building permit, according to Section 5-12 which
<br />states that "No building shall be erected on a plot which does not abut a street as defined in Section 5-2".
<br />This defines a street as any privately maintained right-of-way set aside for public travel 50 feet or more
<br />in width and also any wright-of-way which has been accepted for maintenance as a dedicated street by the
<br />City of Portsmouth. Since Point Lane is not a dedicated street nor 50 feet in width, the zoning ordinance
<br />prohibits us from issuing a permit.
<br />
<br /> Due to the conture of the ground at this location, it is necessary to drain the low end of Point Lane.
<br />If Mr. Warren were to provide a culdesac and a 50 foot right-of-way, the drain easement and drainage as
<br />sho~m on the plat prepared by the Public Works Department on October 1, 1965, the building permit could be
<br />issued."

<br />Motion of Mr. Knight to concur in the report, and that the City Manager so advise Mr. Warren.

<br />68-106 - The following letter from the Chamber of Conmerce, Bernard Rivin, President, was read:

<br /> "At the regular meeting on March 18, 1968, the Board of Directors passed a resolution requesting
<br />City Council to appoint a Portsmouth Commission for the Independence Bicentennial. A copy of that
