<br />to be paid therefor, or the City has not been able to locate certain of the oweners or because of the status
<br />of the title.of certain parcels of the property; and

<br /> WHEREAS, advancement of the work and use of said, State Highway Route S8 will be delayed unreasonably if
<br />the said property is not made available as soon as possible.

<br />NOW, THEP~FORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:

<br /> Sectionl!. The City Attorney is directed to institute eminent domain proceeedings, employing special
<br />counsel for that purpose if he deems it advisable, against the property hereinafter described located
<br />along State Highway Route 58, for the purpose of acquiring fee simple title therein, together with a temporary
<br />construction easement in accordance with and pursuant to Section 25 (F) of the Charter of the City of
<br />Portsmouth (Chapter 229 of the Acts of Assembly of 1966~, and to deposit to the credit of the court as
<br />~rovided by law the sum hereinafter specified tO compensate the respective owners of the various parcels of
<br />land~ as shown on those certain plans entitled Project 0058-124-102, R/W 201 and 202 dated Febr~a~7.-14, 1968~
<br />sheet i0, a copy of which is filed with the Department of Public Works of the City of Portsmouth, Virginia:

<br /> Section 2. The City Attorney is authorized to proceed against each individual parcel and the respective

<br />viewers for the closing of Fourth Avenue from the southern line of Washington Street south to its end at

<br /> I~EREAS, Associated Naval Architects, Inc., and Seaborne J. Flournoy and Georgia L. Flournoy, husband
<br />and wife, have made application ~Dcvacate and close that portion of Fourth Avenue in West Norfolk, lying
<br />between the southern right of way line of Washington Street and its southern terminus in the Elizabeth River
<br />~w~nappearing that notice of the application and request for the appointment of ~iewers was duly posted
<br />on March 14, 1968, on the bulletin board of the Circuit Court of the City of Portsmouth, on the bulletin
<br />board of the Court of Hustings for the City of Portsmouth~ and on the bulletin board of the Municipal Court
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Countil of the City of Portsmouth, Virginia, that Zalmon I.
<br />Blackmon, Loyed W. Gardner, Wilson Rowe, Graydon D. Meginly, and Robert W. Wentz, Jr. be appointed viewers
<br />to view said street and report tothis Council in writing whether in their ppinion any, and if any, what
<br />inconvenience wou~d result from vacating and closing the aforementioned part of Fourth Avenue~"

<br />On motion of Mr. King, the above resolution was adopted, without dissenting vote.
<br />
<br /> 68-101 - "I submit the attached resolution and recommend its adoption. This resolution authorizes
<br />the appointment of viewers for the closing of Columbia Street from its juncture with Frederick Boulevard
<br />and Airline Boulevard, eastward approlimately 128 feet to an extension of the lot line between lots 8 and
<br />10, in block 156. This closing has been requested by Harry L. and Esther H. Goodman. This has been
<br />approved by the Planning Commission.

<br />On m~tion of Mr. Eastes, the following resoluction was adopted, without dissenting vote:

<br />and it appearing that notice of the application and request for the appointment of viewers was duly posted
<br />on March 14, 1968, on the bulletin board of the Circuit CoUrt of the City of Portsmouth, on the bulletin
<br />board of the Court of Hustings for the City of Portsmouth, and on the bulletin board of theMunicipal Court
<br />of the City of Portsmouth.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, ViFginia, that L. A. Clark,
<br />Charles R. Lively, Harry T. Simpson, Edward DeJohn, and H. E. Robertson, Jr. be appointed viewers to view
<br />said street and report to this Council in writing whether in their opinion any, and if any, what inconvenience
<br />would result from vacating and closing the aforementioned part of Columbia Street."

<br /> 68-1~ - "The concession stand at the boat ranup at City Park has been completed. I recommend that I
<br />be authorized to advertise for bids for lease of the operation of the concession stand."
<br />
<br /> Motion of Mr. Barnes to concur in the recommendation of ~he City Manager was adopted, without
<br />dissenting vote.
<br />
<br /> 68-103 - "Through a clerical error, real estate taxes on the property of Herman E. and Julia Williams
<br />on Mascot Street were assesed in dt~licate. They are entitled to a rebate of $20.95. ~ property of
<br />Roy F. and annabelle Ewell%o~nFloyd Street was also assessed in duplicate. They are entitled to a rebate of
<br />$12.00. I recommend that a refund in the amount of $52.95 be granted to reimburse these property owners."
<br />
<br /> Motion of ~!r. EasZes to concur in the recommendation to grant the refund in the amount of $32.95
<br />was adopted, ~ithout dissenting vote.
