April 9, 1968 <br /> <br /> At a special meeting of the City Council, ~eld at S:00 P.M., on April 9th, 1968, there were <br />present: <br /> <br /> R. Irvine Smith, Burrell R. Johnson, Isaac %~. King, L. L. Knight, W. T. Leary, A. P. Johnson, Jr., <br />~.~i.~y~Man~g~d Lee Morris, AssistantCity At%orney. <br /> <br />~%e meeting was opened with prayer by ~{r. King. <br /> <br />~8-t2~ -The Mayor stated that the meeting had been called to make sure that our Police Department will be <br />acting within the law in enforcing a curfew. <br /> <br /> The City Manager sta~ed that the General Assembly, in its last session, amended the Code of Virginia <br />by adding thereto a sect~pn, numbered !5.1-S14.1, as follows: <br /> <br /> Section 15.1-514.1 -"T~he governing body of any county, city or to~n is a~thorized to empower the <br />chief law enforcement officer to regulate, restrict or prohibit any assembly of persons or the movement <br />therein of persons or vehicles when there exists an imminent threat of any civil commotion or dis.turbance <br />in the nature of a riot in such county, city or town or any pRrt thereof which constitutes a clear and <br />present danger thereof; and in such circumstances said governing body zay convene immediately in a special <br />meetiFg and enact an emeregency ordinance or ordinances for the p~oses hereof, notwithstanding any contrary <br />provisions in any city charter or under the general law." <br /> <br />The City Manager presented the following ordinance and recommended its adoption: <br /> <br />"AN ORDINANCE DECLARING %HAT IT IS THE JUDG~'EN~ OF THE COOlqC!L THAT THERE EXISTS IN THE CITY <br />OF PORTSMOUTH AN I~INENT THREAT OF CIVIL COP, i~IOTION OR DISTURBANCE IN THE NATURE OF A RIOT <br />71ND THAT SUCH THREAT CONSTITUTES A CLEAR AND PRESENT DJ~GER THEREOF AND TO PEOPLE ~ND PROP- <br />ERTY WI.THIN THE CITY ;~D E~{POI'~ERING THE CHIEF OF POLICE TO REGULATE, RESTRICT OR PROHIB!T'!~NY <br />ASSEMBLY OF PERSONS OR THE ~OVE%~ENT OF PERSONS OR VEHICLES WITHIN THE CITY OR ANY PART THEREOF." <br />The ordinance was to take effect immediately~ <br />On motion of Mr. Knight, the ordinance was adopted, and by the following vote: <br /> <br />Ayes: Smith, Johnson, King, Knight, Leafy <br />Mays: None <br /> <br />On motion adjourned. <br /> <br />APPROVED - <br /> <br />President <br /> <br />City Clerk <br /> <br /> <br />
